I unfortunately had my DL scanned before entering a certain club this past weekend before I realized what they were doing. I remembered hearing Sharon Harrington (head of MVC) on a radio program saying that this was illegal, so I contacted them about it, and this is the response I got:
Please be advised that it is the Motor Vehicle Commission's (MVC) position that the practice of scanning New Jersey Digital Driver Licenses for the purpose of collecting and using personal information encoded on the license for solicitation or marketing purposes is in violation of the New Jersey Drivers' Privacy Protection Act, a law enacted to protect against the improper use of the license and the personal information contained on it. Please be assured that MVC takes very seriously its responsibility to protect against the improper obtainment, disclosure, and use of personal information of New Jersey citizens that is both contained in MVC records and encoded on the MVC issued Digital Driver License.
Further, the MVC is referring all reported instances of Digital Driver License swiping to other State authorities, including the Attorney General's office, for their evaluation and further action.

There was no line, so we walked right up to security without seeing them scanning other people's DLs. I handed my DL to one person while my GF was handing me her's, and I didn't notice them scanning it 'til they were pulling it out of the hand-held computer. So just be aware that this can happen, but they're not supposed to be doing it according to the MVC. It's pretty aggravating it happened to me, but I'll be much more vigilent the next time I hand out my ID.
