got a dwi.
.0605.
wasnt even buzzen but i didnt stop compelty at a stop sign.
got pulled over and arrested literally staring at my house.
said my house was 50 feet away while pointing at it.
didnt matter.
im going to ****ing bed.

s**t man. i got in my car to visit my ex tonight but got down the street and had to turn around because im a bit to intoxicated to operate a car so i turned around. THANK GOD!!!! sorry to hear about your dui.

i rolled a stop sign right down the road from my house and of course the cop passed and saw me. i saw him brake to turn around so i sped up to try to make it home but came up just short.
im going to demand to see th source code of the breathalyzer, cause alot of times police stations update the firmware on them without getting re-licensed for it. its a long shot but if it works my dwi gets droped...but not my underage possesion of alchy and stop sign thing
im looking at 1-3 months depending on how much i want to spend on a lawyer

you can also demand to see the maintanance record for the breathalyzer and and if thers no proof that it was taken care of when it was supposed to then thats ur best bet for trying to get out of this
and demand to see proof that the cop can even use it, they gotta get trained to use just like radar

just talked to some people...said i will probably get the dwi droped and i wont get the surchages and whatnot cause it was only .06 ...damage is done tho, rents are droping me from their 'surance, and ill probably be put on probation which means no weedies for a year :[
whatevs better then a dwi.

That doesn't mean a cop will stop arresting you if you go home. It means the cop didn't want to deal with whatever it was.

your absolutely right. but i havent even talked to a lawyer yet so im just going to have to wait and see what happens.
and to answer the other questions... i had a few (3-4) beers, had my friend drive home from closter which is roughly an hour ride. he droped matt of then went and droped himself off.
i was about 100-200 feet away from my house and i told the cop it would be delightful if he would just let me walk home and leave the car for the morning but...he was a young cop. therefor he just had to make sure he got his dwi. he wasnt to happy when i only blew a .06 tho :lol::lol:

when i go back to school ill stop by the law library and check if im right about cops not being able to do anything once ur in driveway and they dont got lights on yet b/c once i start turning in he cant put on his lights and expect me to stop thats crazy!!!

Doesn't matter what you are told at school. That is not correct. That would mean that I could race my ass home if a cop is tailing me, pull in the driveway, and say "nyah-nyah you can't get me".

come to think of it, i remember when i got pulled over in my friends driveway. and my buddy got pulled over making a sandwich in subway (someone followed us into the parking lot and called the cops on us). neither resulted in a ticket though. i don't believe that jurisdiction thing for a second.

not to sound like a smartass, but what if the policeman didnt see who the person was that ran inside, and there were no witnesses ? then the accused has the right to remain silent, and doesnt have to say anything right? Then if it went to court, plea the 5th?

Apparently all cases could be thrown out if this is found to be the case.

the breathlyzer point is moot. it may not be accurate but it won't give a false positive. and since he can't have any alcohol in him, he's in trouble regardless of the alcohol content of his blood

If the breathalizer wasn't properly calibrated(or something to this effect) then the results get thrown out completely. I know someone that was able to avoid a DWI charge because of this, but that was about 20 years ago so I'm not sure if the same scenario applies today.

Yea, but what they are saying is that if they don't have a license for the version of breathalyser that they are using, then it shouldn't be able to be used as evidence in a court case against him, and then they have no proof that he had anything to drink.
Not that I agree with that....but the law is what it is.

that link to the article where the commonwealth wouldn't turn over the source code makes me wonder if they're hiding a skewing or not. they say its a 'trade secret' but unless you've got something to hide, why hide it? just show the code and you still get your dui.

I've seen articles along those same lines with radar guns. The companies don't wanna risk having their code compromised, and they would rather see a few smart/rich people get off the hook than lose their business to another company using their code....

If they were to show their code it would make it a hell of a lot easier to make a jamming device, or even better a device that decrements your speed value to say you are traveling at a much slower rate then you are. I can't believe that they would actually hand over source code like that when it concerns public safety. Maybe they do, but... wow...
