Looks like the champ is going down big time on this one.
The Supra, which came from the factory with 300 to 330 horsepower, had been souped up to have more than 400 horsepower, the suit says.
I don't see why the above quote from the suit makes any difference. Idiots of any age are going to street race whether they're driving an 80hp car (w/ or w/o fart can) or a 500hp car stock from the factory. I've seen 2 dopes race box trucks on Rt 9 for God's sake...it took 'em a long time to get up to speed, but they kept going neck and neck way longer and way faster than they should've been going.

a couple of things bother me about this. first:
"A major issue in this case will be John's failure to have a seatbelt on," Wineberg said. "He wouldn't have been seriously injured if he had been wearing it."

Tragos scoffed at the notion. "The seatbelt didn't hit the tree," he said.


he wouldn't've been seriously injured had he been wearing his seatbelt. how can you blame someone else for your failure to put your seatbelt on?

He also let his son "drift'' – or control the car while it is going sideways at a fast rate of speed – on public roads, the suit says.

Once, Hogan was with his son in a Mercedes when his son was stopped twice on Alligator Alley by the Florida Highway Patrol for driving more than 100 mph, the suit notes. He let his son keep his driving privileges.

i don't understand how the owner of anything can be held liable for the operation of it. how it is known what hogan/bollea knew or didn't know or allowed or didn't allow is beyond me, unless they are going to produce some video evidence of the hulkster allowing his son to drift on public roads. having his wife jump up and down regarding street racing most likely isn't going to help his case, but if they are divorcing, then what she says should have less of an effect on him. what she said may have been taken out of context, too.

when it ever became a parent's responsibility for suspending their son or daughter's driving privelege is beyond me. i thought that was up to the court? also, there is a bit in there about his father signing off on his son's driver's application - i didn't know they were expecting parents to also sign an app, as i was the only one who signed mine. maybe the laws have changed since then?

Bollea's ethanol serum level was .055, and he was cited for driving as a minor with a breath-alcohol level of .02 or higher. This was one of the reasons he lost his driver's license.

maybe bad reporting, but this is the first mention of the kid losing his license. outside of this, we aren't given any of the other reason(s) cited.

the supra smacked into a tree. how this has anything to do with graziano is not listed. it's kind of hard to form an opinion how things should go without that information. all we really know at this point is that a suit has been filed against the kid and his parents, and the kid who was driving the other car. sounds more to me like they went after the "deep pockets" in this case, meaning terry hogan/bollea.
