View Full Version : caught doing 31 mph over. need advice!

Hey guys,
I got caught on the GSP doing 86 in a 55...i thought i was keeping up with traffic...the trooper who pulled me over didnt think so. Well anyways, its a 5 point ticket and my insurance is going to skyrocket. This is my first speeding ticket...other than this my record is clean. I talked to a few lawyers...one said worse case scenario he could get me down to 2 points, and usually he could plea bargain to 0. But it would set me back about 600 bills, probably more. I think it would be worth it seeing as how my insurance would go up if i didnt.

This happened in woodbridge and he says he frequents there so hes sort of friends with the prosecutors.

So i have a few questions that need advice...

1) would it be wise to hire an attorney? or do you think i could plea bargain with the prosecutor myself because its my first offense.
2) if i did get 0 points on my lisence from this ticket does my insurance still go up?
3) does anybody know anyone that could hook me up in woodbridge? or anybody know how the prosecutors are there?

Any advice would be GREATLY appreciated. Thanks for looking.

being that its your first offense they will be more willing to drop it down than if you had previous tickets. if you are lucky enough to get 0 points then no your insurance will not go up but you will still have to pay the fines to the town. thats all they want anyway is their money...good luck

I got 33 over last year, go to court and talk to the officer there, they dropped the other ticket and the speeding from 33 over to 14 over and it was just 2 points. I wouldn't hire a lawyer, cause its not guaranteed that he'll do any better than you could and it will set you back pretty good.

Lawyers don't do **** but plea bargain. You can talk to the prosecutor yourself, they will most likely drop the points for a higher fine. Try to act like you're sorry about speeding and that you've learned your lesson, etc.

lawyers are useless, PM me i can help you get it all dropped, but first of all did you admit to the cop u were speeding? and second how did the cop get ur speed?

Go to court and talk with the officer, if you can bring a copy of your clean driving record to show him. Be as respectful with him as you can and let him know you are sorry, he may drop it down for you.

Don't be so sure....my insurance went up some when I had my one and only speeding ticket reduced to an unsafe (0 point) ticket in court. The insurance company can check your driving record, and they can raise your rates for pretty much anything on it.

They all do. And NJM won't boot you for a first offense, but if you keep it up your dad will start getting letters in the mail from them saying that if you don't get your own policy, they'll drop his.

yeah i keep hearing to plead for something else, get no points but pay a huge fine. but i dont know if they would do that for a 5 point ticket...thats the highest ticket.

as for your advice...to slow down...i think ill take it. but honestly the cop knew the gsp pretty well...he got me AS i was passing sum1, and it happened to be on a downhill part so i was going faster than i thought. o well. thank you for your advice though.

New Jersey has this thing where you pay extra money to lose the points, I think they said it can only be used like 2 times every 3 years or something. It was like an extra 250-300 dollars plus fines but it reduced my points to zero and your insurance company is not allowed to raise your rates. This was all done with my public defender when I showed up in court.

Yes, that's Unsafe Driving. It's not really a NJ program or anything, it is just an easy way for the local municipality to get a bunch of cash from you. They don't benefit from you getting points on your license, so if you're willing to pay big bucks to get them off, they'll usually do it.

When I got my ticket I was doing 68 in a 50, and the cop was nice and wrote the ticket for only 59 in a 50 (next bracket down, only 2 pts.). I still went to court, the prosecutor knew how fast I was going (cop put the actually speed in the notes) and he dropped me to an Unsafe. It cost me about $450, but no points was worth it. I also had a clean driving record at the time, so that does help.

yeah i was doing nearly double that...do u know if theyll drop a 5 point ticket?

you can get 12 points dropped at once depending how good you are and thats W/O lawyer for record

plea bargain yourself. Unsafe Operation of a Motor Vehicle ~$400 and maybe some court fees. you could try this (http://www.ls1tech.com/forums/showthread.php?p=7719061#post7719061) but i don't know if it would work.

a public defender is a lawyer provided by the state for those whom can not afford an attorney on their own. you hear it all the time on cops in the miranda(maybe?) rights. "if you can not afford an attorney, one can be appointed to you." its creating equal grounds i guess.

My ex called me last night and asked me what she should do b/c she's down the shore for prom weekend and got hit with a bunch of tickets when a group of 4 cars got nailed for 76 in a 55, including Reckless. She didn't like my advice and called me mean? :shrug: :lol:

Dress nice, bring a parent if you are young. Show upmost respect and sympathy and cross your fingers that the prosecutor had a camaro when he was a kid like mine did :D

Got my 5 point reckless reduced to $450 unsafe. No points.

Speed with MANY people. never got caught. woman was first to hit 95mph on rt78/22 coming back from cabelas. were in a hurry, son was coming home from school, got here before him.

My turn was rt50?highway 50? coming back from WV doing almost 100 following a person in a company focus or neon. "they only have 1 major gas company, and don't patrol the highway well" anyway slowed down because it got crazy after a few miles. ended up having to reattach the one clip on her bra. 2006 suzuki aerio SX Premium AWD

its called the unsafe driving statute. the prosecutor will allow you to go before the judge and plead that you realize that you were driving unsafe and accept the responsibility for unsafe driving, it gets bumped down to 180 dollar fine.
you can only use it once though

:) in a 50-55 it is. anyway i was just f-ing around. my point was speed in big groups, BIG groups. only thing is if your in front behind or caught by a speed trap. plus insurance shouldn't kill you over 1 thing.

nahh trust me its not always like that. when i went to court (this is an old thread so everything is done and over with) i asked the prosecutor for unsafe operations and he didnt let me plead to it. its all about what the prosecutor is willing to give you.

so he gave me a 4 pt ticket...i talked to the judge and he noticed i wasnt too happy i asked him about unsafe operations and he said ill cut you a deal and give u a 2 pt ticket..which he did. so it worked out ok.
