The short of it:
A dealership sold him a 2009 Eclipse as a "new car" when in fact it had been sold already but never titled (technicality), since the trans blew within 24 hours of the first owner taking posession. The dealership was/is giving him the run around, so when he found out they were hiring for a new sales position he went in and fake interviewed, blowing up their spot in front of a number of possible car buyers.

Part 1:

December 16th 2008

I went to a dealer on and purchased the 2009 Mitsubishi Eclipse GT. I was only given 1 key so I had to go back to the dealer ship the day after next to have a new key made as well as have the value guard protection services performed. When I left the dealership I noticed the tire pressure gauge was on and when I started to pull out I heard a brief scrapping noise from the transmission. I had thought maybe it was due to the weather being cold.

December 18th

I went back to the dealership to take the car to have the extra key made, and check the tire pressure.

December 19th
I went back out to the dealership to pick the car up and I was given a key and took the car back home. It still made the noise and I contacted my salesman and told him about it and I also told him the key they had programmed for me was not working. I set up and appointment with him to bring the car back out to have the key programmed and have the noise from the transmission. I specifically told Luke that after you start the car up after being off. You put it in first gear and when you start to take off when it gets up to 1200 rpm it makes a brief grinding noise.

December 20th

He contacted me the next day and told me my key was programmed, he found my other key, and the car had been looked at. According to the service guy he thought it was the transmission pump coming on. He even made sure he heard the sound. I went out and picked the car up and left.

Later on in January I was going through my glove box and I noticed there was a notice of property insurance with all my cars information and the name and address and insurance info from someone else. This kind of concerned me so I called my salesman and his assistant and both of them said the car had never been sold to anyone and it was probably someone who tried to get a loan and it fell through.

In February I drove 2 other 2009 Eclipse GT 6 speeds and neither one made the sound mine made so I had my friend Jason who is an Audi mechanic listen to it and he told me he believed it was something in the clutch, flywheel, or transmission itself.

I called the dealership and set up and appointment for March 2nd and explained to them in detail the problem once again.

March 2nd

I took the car out and showed it to the service guy. I took him for a drive in the parking lot so he could hear the sound it made. I did this not once but twice and he agreed he heard the sound. I had even told him what my friend had said.

March 3rd

I received a call from the service guy and he said the car had been looked at by the mechanic and driven around and everything was perfectly fine. I wasn’t happy and I told him he even admitted to hearing the sound. I asked for him to have the service manager to contact me. I waited for 2 hours and I never received a call. I called and asked to speak to a manager myself and I spoke to him. He said he would look into it and give me a call back. I explained to him the problem in detail and this was the 2nd time I have had it out there and its not supposed to make that noise. He said he would call me back and look into it.
I went home and pulled out the notice of property paper and called the lady on it. She told that she had bought the car from the dealership in June and less than 24 hours she was driving it and the transmission locked up and would not shift. The car was then towed back to the dealer and she was given another new eclipse but this one was an automatic. The car being sold to someone else and the car being broken was never disclosed to me when I purchased it. I called back and told him I had found out and he just kept saying he would look into it and see what he can do. I told him I had already contacted my insurance and loan holder and if I had to get an attorney involved I would. He said it would be in my best interest to let him talk to finance and then call me back in the morning. I hung up with him and attempted to contact the gm and I was told his voicemail was not set up I would have to contact him tomorrow. After that I went on and looked at the dealership and they had an F rating with the Better Business Bureau with 29 complaints in 36 months. When the original lady purchased the car it had 29 miles on it. When I purchased the car it had 117 miles on it. I was never told the car was sold to someone else and even when I asked after I first called about it back in January it was denied. I was told no one had ever taken delivery of the car even when I asked about the document. I was also never told the car was returned due to mechanical failure or that it had been repaired which obviously it wasn’t.

Is there anything I can do? They still have the car but I really dont want it anymore

No videos or pics but here is how it went down….

I walked in and met with the interviewer and we sat down and started talking. I told him how much I loved cars and even though the auto industry is having tough times I still feel I would like to start a career with in it etc. So he looks over my resume and said it was very impressive. He started telling me about the job functions as a salesman and what I needed to know and do etc. Here is where it gets good….

Me: That sounds great so let me ask you this…Will I be able to sell new and used cars?
Dealer: We actually have salesman for new and salesman for used but they are separate.

Me: So let’s say I see someone really wants a car but all we have on the lot is a used car can I recycle it and sell it as new?
Dealer: It depends on if “that car” had ever been titled.

Me: So lets say I make a sale here when someone takes delivery of what I sold them am I able to give them some type of lubricant?
Dealer: Lubricant?

Me: Yes like oil or grease
Dealer: I don’t see a problem since those type of things help keep cars maintained properly. Never had that question before.

Me: I have to tell you I think I would be a great fit for this company based on my experiences
Dealer: What do you feel would qualify you to be a good asset to our team?

Me: Well I have a vast knowledge of many things. I am very confident in my abilities to relate to the customer, fraud, cars, extortion, knowing my product, hiding the truth, being a team player, covering up problems, and doing whatever it takes to put the customer in last and the company’s bank account first.
Dealer: Sir some of the things you just said concern me. At this dealership we play by the rules and obey all laws and our number one priority is to satisfy the customer.

Me: It’s ok I know you have to say that kind of stuff but you can trust me
Dealer: Sir what I said is the truth

Me: Really? That’s odd because you sold me a BROKEN CAR THAT WAS ADVERTISED AS NEW AND THEN TRIED TO COVER UP SOMEONE ELSE HAD IT BEFORE ME!!!

By this time other people heard me and I stood up and looked at the people in the show room and I said ladies and gentlemen if you are attempting to buy a car from this dealer I strongly suggest you check the BBB and AG website to see they have 30+ complaints and an F rating before you throw your money away here. I had the print outs in my folder and I threw them down and a lady picked it up and said OMG it’s true and all but 1 person walked out. At that time they politely asked me to leave. So I did. Well I didn’t stop there. I noticed as I was getting in my car there was a young girl looking at an Eclipse. Since I was in dress clothes looking important I drove up to her and got out and said hi are you looking to buy an Eclipse? She said yes and I said guess what they suck and this dealer will rip you off. I showed her the BBB report and I told her not only is the dealership crap but the car is too. Needless to say they left and then I was told to leave or the police would be called.

he needs to get a lawyer there is something called a lemon law
Also the best thing to do it rent out a billboard within eye shot fo the dealer ship and enlarge and print the BBB F rating report on it.

His case was denied and he's looking for other avenues to get his money back.

Yeah it was the NCDS board. Yes the inspector came out and said it was metal hitting metal. The dealer and Mitsubishi both lied and I gave them the letter from the girl and also the name and number of the Attorney General whom they both admitted to having to fix the clutch over the phone and in front of my girlfriend which mitsubishi denied completely in their response. Had they wanted to find proof of what I was saying it was right there for them. They had a notarized letter from the girl who orginally took it off the lot, a letter from my g/f as a witness that was notarized, and the AG info. I sent a total of 112 pages of paperwork, letters, forms, and everything to proove my case. Now had this been the 1800's and wild west and I got a bad horse this would have been handled completely different

Drive it into a bad city, bust the driver side window out, and leave ti with the keys under a bridge for others to take, or drop it into a lake. Don't want to look conspicuous, call a friend to do it ;)
