The internet is still like the wild west in terms of the laws regarding to it. Its still young, and the not many cases are made it to the supreme court for constitutional interpretation. I think in the next 5-10 years, you will see a lot more cases related to free speech and the internet hit the Supreme Court.

You didn't get the memo? You're not allowed to say anything negative about The Messiah. If you do it'll be taken off of websites, your product deemed illegal or your store shut down. It's funny how the double standards work, but then again the media has also been neutral. :rolleyes: I'll stop there so the thread won't get locked(though it probably will anyway lol)

The government did not take the picture or account down, flcker did saying it violated a copyright, and they were just protecting themselves from a possible lawsuit. The reasoning is believable.
The problem is that The Time magazine cover, Obama picture, and Joker features are NOT copyrighted. Also, to dig further, there are other pictures on Flcker using the Time magazine cover.
So, did Flcker take it down because it was inslusting to Obama, or because they're lawyers didn't do their homework? Did Flcker get a complaint about the photo, and that's why its taken down.
Photos get removed my every image hosting website. I don't see people complaining about that when it happens.

Do not blame the government on this one, its Flcker who took down the photos.

hahah 2 dads..... hey cdacda ill admit your kinda right on what you said... i took it alittle out of context... but there really isnt any copy right infringements on the picture to be taken into account... lawyers have commented on that... i also read another article where a member of flickr was banned a few months back for commenting on some white house or airforce one photos (cant remember what the article said) probably because the comments weren't to their liking... now i can say he wasn't threatening because i never saw the comments but... you cant deny that the fed doesn't have the media sitting in their lap asking for lolly pops... and the internet is a for of media... you know there is ways for them to get things like this done with out having to have obama say hey i don't like that picture take it down.... that's where i was coming from....

Yesterday Yahoo fired back at everyone who complained, saying that they were required to remove the image pursuant to a DMCA takedown notice. Flickr’s director of community Heather Champ says “In this intance, the Yahoo! Copyright Team here in the US received a complete Notice of Infringement as outlined by the DMCA (Digitial Millenium Copyright Act). Under the DMCA, an individual may choose to file a counterclaim”

She added “We very much value freedom of speech and creativity.”

Yahoo (who owns Flickr) claims they received a copyright infringement notice, but doesn't say who it was received from. As the article points out, had they shown the image and complaint to their lawyers, they would have been told that it was perfectly legal, and they should leave the image alone. Sounds to me like the notice was just a very convenient excuse for them to take down an image that they don't agree with.

And to address the "this thread's getting locked" comments.....it will stay open as long as no partisan politics discussion comes up and every stays civil.

Hmm. Here's how I see it. If you own a server or web site, you control the **** that's on it. Since you OWN it. Just because you allow other people to come on and post their images or messages does not mean that they have any rights about what is allowed. The nice thing to do is to let stuff stay, but you don't have to.

Free speech protects you in public. You can stand on the street and say whatever you want. On the Internet, it's not "public" even though anyone can see what's up there. You are always on somebody's server, which is somebody's property.

Over the past 8 years, republicans have stood by thier man as he ravaged the middle east, invaded a soverign nation unprovoked, while he led the American public around by the nose on the world of "Freedom" and "Saftey".
********. I have my qualms about Obama, but most of you are tearing down anything he could possibly do to help this country on its feet, all because of his political affiliation.

Case in point.
Democrats wanetd 4 billion for CARS/Cash for Clunkers. The republicans took away all but a billion, and said make tha twork for a month.
Then the same republicans want to mock the Dems for not being far-sighted, and asking for more money when the massive pent up demand for cars surged and every dealer was being flooded by every day working people trying to buy a new car, but coudlnt because of the economic **** storm that a republican house, senate, and president let happen without a single urging of Americans being conserviative in thier spending.
Isnt that what a Republican is?
Instead, they worred about spending billions in "emergency funding" for the wars in Iraq and Afganastan.
I dont think that Obama gives two ****s about a picture. The man clearly has bigger things to worry about, like making sure that this country, even with sucha hatred for a man they dont know, gets back on their feet.

Also, no one had problems when the goverment was giving back 600 dollars in a tax rebate, but when the goverment wants to spur an industry, while at the same time decrease the number of poluting vehicles on the road, as well as reduce our dependance on foreign oil, by giving out money, people start to bitch about thier tax dollars being spent.
I know that Im happy as hell that my tax dollars took 4500 of my new Malibu.
