Got pulled over for loud exhaust the other week. Ticket is written up as loud exhaust with the staute being 39:3-76. The officer says to just go online and pay it, no court appearence required. So go onto the site and this info comes up:
39:3-76 Dangerous Exhaust Gasses
This ticket is not eligible for payment. Please contact the court or refer to the back of the traffic ticket for additional court appearance information.
I should just call and ask what to do right?

looked up the staute. Heres what it says.
NJSA 39:3-76
39:3-76. Dangerous exhaust gases
Every motor vehicle shall be equipped and maintained so that exhaust gases cannot injure any person or animal, and no person shall use any motor vehicle so as to cause or be likely to cause any such injury.
I'm just going to call tomorrow.

he probably thought you didn't have a muffler or a bad exhaust leak.

if he simply wrote that without saying a word, then its pretty much thrown out b/c there is no evidence that your fumes are harmful if they werent measured

did he check it with a dB meter? do you have a working cat? muffler installed with no exhaust leaks?
I got pulled over for loud exhaust told the cop i had a cat, muffler, no exhaust leaks and i would even start it up...got a warning. They have to prove its louder than the 95dB no human ear is trained to know whats louder than 95dB

i'd fight it.. one of my buddies was a state trooper now on swat but, he told me you need two things to get pulled over for your exhuast.
1. loud
2. smoke
if you don't have both the cop can't pull you over.

lol i got that ticket before except on my ticket it said Loud Exhaust...usually only get one when your doing something else naughty and he's giving you a break

Loud exhaust is not stated in the statue, there is a seperate statue for that so therefore he wrote the wrong # down and it is elegible to be thrown out of court.
p.o.'s are required to fill the ticket out properly and exactly,
if a date is wrong, d.l. # is wrong it is a eligitame ticket.
fight it.

i guess it depends on the town/municipality your in.
i have had wrong info and beat it before, but i haven't got any tickets in quite a few years.
this is the proper statute # & explaination:
39:3-70 MUFFLERS
"Every motor vehicle having a combustion motor shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise AND annoying smoke, and no person shall use a muffler cut-out, bypass or similar device upon a motor vehicle on a highway"

Tim, you still haven't answered the questions about your exhaust setup.....do you have a cat and muffler installed, with no leaks?

Muffler is in stock spot, no leaks, and theres the common cat mod that most people have on this board. He didnt check anyhting. Didnt look under the car either.

yupp. But he said he gave me a loud exhaust ticket and thats what the discription says, but the title is for the other. I'm calling Monday.

Yea, he said he wasnt giving me the no cat ticket or the no inspection ticket. I got to get under neath the cart and see where I can stuff a working cat. I'm thinking intermediate pipe but might be too close the the ds.

ok then he has one, and moves it from the y to the intermediate, now he fails for "altering emissions systems".
if you are going to bother running a cat just to be legal, it NEEDS to be on the y-pipe

From a matter of practicality (as in not the letter of the law), I suspect that a single cat in a generally stock location will suffice for inspection, regardless of OE design.
true but you can get away with it if they are emmisions headers and you have cats...

No catted Y available for LT1 cars asides from Kooks and thats very pricey.
But its very doable to have two cats welded into the ORY.

no, you generalized it. the 3.4's still had a single cat in 95. 3.8's available in conv cars had to meet carb emissions which required dual cat. you covered nothing!!

I have the hooker ory pipe and yes a cat would work on the pass side but it is physicaly impossible to put it in the same area of the drivers side as the pass side. The pipe ovals out to clear the fuel lines on the driver side. Next nice day I'm going to see if I can get under the car.

If you mount one cat where the y pipe and i pipe connect, you should be fine.

Yea, thats the plan. If space allows it between the ds beign there and the body mount for the trq arm. I'll have to look at it.

its possible the cop knew that you didnt have a cat just from the smell of your exhaust/car....its deffinately easily recognizable to anyone in the know :nod:

I called and the officer wrote the wrong statute down. Got a new court date and was told he will make it the right one. All is good.
