The sad story of my friend, last monday he got a 2006 Gto,M6 with 10,000 Miles. He is ok only got a scratch on his finger.
* Been saving money since his first job to get this car
* Had every dollar he needed and bought the car
* last tuesday he drove 600 miles each way to nc, left friday morning
* today i get a text my car is totalled..bad accident, wasnt my fault
* old lady ran a stop sign, he t-boned her, when he hit his car spun and the side of his car smacked her car, airbags went off, battery exploded
* I remember back in high school i would ask him to hang out and he said no man i have to save money to get that car one day...
* Here we are 7 days after he gets his dream and its totaled because we have old people on the roads that shouldnt

hate stories like this... hopefully he will get compensated well for it... at least (from the story) he seems to sound ok... and thats always the main thing... cars are replaceable...

WOW that sucks! If the accident didn't take out the old lady (and it was 100% her fault) I would really be tempted at that time to do it myself.:twak:

That almost made me cry seeing that. Was a beautiful car. Insurance will hook him up and he'll be back on the road in no time I'm sure (with a new car granted). Was the elderly lady ok?

People on the road keep getting worse. I had my truck for 3 weeks and an old lady decided to make a left turn from the center lane. Hadn't even made the first payment on it yet. On a test drive last week in a customers car sitting at a traffic light (red) and some old guy almost plowed straight into me.
It's not just old people tho. I've had a good amount of close calls with younger drivers too, think they own the road and that everyone will yield to them. The license system needs to be revised/updated, stricter testing and retesting every so often. Maybe try to weed out some of the incompetent drivers.

nah, anyone can put on a face and pass a test then do whatever they want when they are set free. really need a greater enforcement of traffic laws and a larger police presence. though the economy isn't helping, red light cameras and the like could help the situation. really comes down to the overpopulation of jersey i guess. can't wait for summer :-x

(I only set that limit bc I looked up Italy, Germany, and France and for driving school, lessons, etc. and it wasn't close to that.)

not to bad. i think joe should ask her for the 2500 if she doesn't give it then he should sue since he spent so many years working up to that car. and does his insurance go up now? if so he should sue for even more money lol

we should attach stickers to cars being driven by old people so that we know to watch out for their bad driving. Its statistically proven that the elderly are more likely to be in accident despite their average speed of 45mph on the parkway

no, thats to subtle. we want everyone to know where they are. i'm liking a big orange flashing like on top, like tow trucks, and a loud blaring siren. cause you won't notice the sticker as they blow through the stop sign. the light and siren though. very effective

how about we focus on the fact that this is actually profiling. which is highly frowned upon in our society as well as being illegal. so they are now making profiling legal. awesome.

good luck, unfortunatly i had an accident with my turrdgen and it was my fault, went thru a red turn signal light and the lady tried to sue me for money ..
interesting story actually because i got 2 tickets from the accident failure to obey signal(2pts) and careless driving(2pts) and about 2 weeks before that got a tailgating ticket (5pts)
they combined my court days to one and the lawyer got me off no points and the lady got no money out of me
it must have been a world record or something... but i had to pay like $400 to court and my dad had to pay the lawyer.. thanks dad!!:cry:

yes it is because for most young drivers we do not own our own cars. my z28 was registered to my moms name, i paid for all of it yada yada blah blah. The key thing is thought that if i was driving my Z28 and i got pulled over a cop asks wheres your sticker? i'll just say oh its my mothers car im just borrowing it for the day and she doesnt want stickers on her car..........thats going to happen with 99% of drivers who are in their teens

we're off topic, but I think you have to have the sticker on any car you driver, regardless of whose car it is. I thought they are affixed via hook & loop strips

WOW i wanted to cry n give ur friend a hug after reading that!! i think after old people hit a certain age they should be tested every year for driving, i almost got hit head on the other day cuz an old guy took a turn in his cobalt like he was driving a Mack truck

Generally auto insurance payoffs are negotiable. You don't have to take what they offer, just decline it and say your going to get an attorney and take them to court and the payment usually goes to full market value. The insurance company knows it will cost them more to argue their position on the value of the car than to pay fair value.
Just something to keep in mind if this ever happens to you.
PS often making a counter acceptance offer with supporting documentation (photos, receipts for added value items, etc) will also get the payoff raised.
just because they are giving him less than what he paid for the car, doesn't mean they are giving him less than it is worth, that is why gap insurance exists. he can try with the insurance and maybe get lucky, or he can try asking the woman and maybe she will be nice... or he can sue and the courts might hook him up but he will then be out almost that 2500 after paying for legal and court fees....
its a crap situation, and its always worth a try, but advise him to not get his hopes too high before he weighs all his options

Yep, you are absolutely right. Just because you think your car is worth more than the payout offer, do not expect to get it without supporting evidence.

Perfect example of not being a mushroom. If you feel you are being wronged, speak up and get noticed. I would also imagine that your friend was polite, yet firm in his discussions with the insurance company. Being professional, and not being sarcastic or insulting will go a long way to making your position seem reasonable.
Also using slang/trendy terms in your speech like "Oh man, this is payout is an epic fail", is sure to clue in the adjuster that you are not sophisticated and can be crapped on accordingly. Which they will gladly do.
My hat is off to your friend for a successful negotiation.
