so i received 2 tickets in the mail recently;careless driving and leaving the scene of an accident. This struck me as odd cause i have not been in accident...ever. so i call the records department to find out what this is all about. Turns out that what happened was around 10pm i was driving my car and i passed one of my neighbors who was walking her dog on the sidewalk.When i drove by the dog got "frightened" and then proceeded to pull the lady to the ground breaking her rib. To make this perfectly clear i DID NOT touch the lady or the dog and since there were parked cars and she was on the sidewalk and i was on the street, i was at least ten feet from her.
Obviously i am not very concerned about loosing this case in court since it is my word against hers unless Fiddo learns English also lets not forget that i did not actually hit her.
Im posting this to warn those who would ever have the misfortune of driving through Metuchen with a modded car. Also i dont wanna study Chinese

It seems like it won't be your word against hers, because you guys don't contradict each other. I still wouldn't just go in there unprepared, I would talk to an attorney. I'm no lawyer, but I think leaving hte scene of an accident is a felony.

If I understand this right, she is claiming that something he drove carelessly and that resulted (even if tangentially) in her injuries, and he left.
Requesting discovery from the court will only provide you with any real evidence that is planned on being entered in to prove the plaintiff's case. At this point, I doubt it is anything besides the police report at this time.
OP- How did you find out about the suit and in what court are you being sued in? Also, if you were served with a summons and complaint, you need to answer in the complaint and you only have a limited amount of time to do that. Be sure to post up here before you answer.

I would get a lawyer and have the lawyer contact her explaining how you plan on not only defending yourself but also counter-suing for court fees, legal expenses, and wages lost during time in court.
I bet she'll **** her pants and drop it. In this day and age when the old (sorry to anyone not "young" but its true) try to take advantage of the young the only way to win is to prove your no dumbass and you can defend yourself and spin the whole thing around when the ball is in your court.

Lol that doesnt make you sue happy bro it just makes you a person that uses the legal system for what it was actually intended for...
As for the topic. See I would say go try to explain to her how ridiculous the whole thing is and that you completely plan on defending yourself and counter suing just to see if you can nip the thing in the bud but I think thats bad legal advise.
Btw perhaps you should go speak with the officer who filed the report and issued you the tickets? See what he has to say. I would put on the good memory hat and remember everything he says. If he even hints at the fact that its ridiculous or that he only filed the report because she insisted its just more **** to fling in court.

Yeah your absolutely right. And no it doesnt say anywhere hes being sued so I guess the term "counter sue" is incorrect in what we were saying.
I got ****ed like that in high school. Someone decided to file a complaint for reckless driving for doing a burnout. Little did I know that it wasnt actually issued by the cop that gave it to me in school. Wish I had known that cause I would have pled not guilty instead of having it reduced.
I bet if you go and plead not guilty she wont even be there to protest.

well remember man theres 3 sides to every story...one side, the other side, the truth. their stories contradict so someone is giving wrong recollections or faulty information.

yeah if you think outside of the box it could be that the town has been getting a lot of complaints and this could be a perfect opportunity to shut them up by forcing you out of their neighborhood / getting rid of your car.

Public defenders aren't always free. If you use one, they will make you fill out a form for eligibility and then it will cost you a few hundred bucks.
Get a lawyer. A GOOD one. This reeks of "How much money can I get out of this guy because I slipped and fell?" As soon as the traffic court case is done, this woman will most certainly file a civil suit. No matter how ridiculous this may seem, remember that an idiot who spilled coffee on herself got millions.

Well I'm glad for you that ya got the easy way out to not getting your ass sued.
As much as I hate to say it its young people (such as yourself) that settle for the plea bargains and enable the legal system (especially municipal) to walk all over us like we're "stupid kids".
If I was you I would have been contested all charges in court, then when she filed a civil I would have counter sued for defamation of character, lost wages, legal fees etc. I understand that not everyone wants to take the low road to be "right" in the end but **** is just out of control with what people get away with.
Heres the couple things I'd really like to know:
Was she even there in court?
Did she speak her side of the story or was it a total plea bargain with zero "trial"
Did the judge/prosecutor find the whole thing rediculous when you explained youself?
O and do you have it in writing that no further civil suit is to be filed?

Man that sucks. I can't see how she could prove that it was your car and not a cat that caused her to be pulled down. It isn't like they can cross examine the dog to find out why he was scared. Or her walking on a sidewalk at night and tripping over a crack and blamed it on someone else. All I’m saying is that I would have fought that one if it even made it to court.

Yea, I think I would of contested everythign and counter sued, in this day and age, judges are becoming more keen with stupid frivilous suits, and I'm sure that would of gotten thrown out of court. Did you use a public defender or an actual lawyer, cause I think he **** shafted you on that.

It's really not that bad of a deal in the end. I'd rather pay the state for a traffic violation than pay for her stupid medical bills. But it is a shame the police even took this seriously.

sometimes you gotta cut your losses and take one for the team. a traffic ticket and no chance of her suing you is way better than taking a chance in court and not only losing both charges, ending up in jail and having her sue you afterwards.

See, I probably wouldn't have.
A 2 pt careless ticket + insurance surcharges is probably still less than having to hire a lawyer in a civil suit for 4 hours, let alone an entire trial.

i agree too. i asked my mother whos a judge and she said something definately sounds out of place, especially since they can't prove that you were at the scene, hence no witnesses, you shouldn't have received anything and the case been dropped. theres no witnesses, no evidence that you caused her accident, the waiting period seems like she might've consulted with family member or friend that convinced her to try to get money, and it definately seems that someone shafted you because now you're going to have points, surcharges, and these things no one wants.

The hell are u talking about not getting the full story? i decided to take the path that was less bad for me. If i got found not guilty she could have still taken me to civil court so i took the option that keeps me from spending months dealing with court. id rather get a ticket than miss more class

It just seems odd that she would forgo any type of civil suit if she was really injured. Knowing you got 2pts out of it wouldn't heal my supposed injuries nor would it reimburse my out of pocket expenses.

I'm just curious, who came up with the idea for the civil suit protection if you admitted to careless driving? Your lawyer or hers, or even the prosecutor? Yeah not to mention I'm still awaiting the answers to the 3 or 4 questions I had after the "verdict" came in. Most importantly whether you actually got that "no civil suit promise" in writing...
Like I said from the beginning once your tickets were dismissed (which they would have been) no lawyer short of some sleezeball dumb ass (The guy from the simpsons comes to mind) would take that case because it had already been settled in municipal court that you werent at fault for what she blamed you for. A civil suit would have been redundant.
And further like I had said she woulda **** her pants and realized you werent some dumb idiot once she received the paperwork you would be counter suing. Hell I'm sure the legal letter announcing the intent to counter sue for court and lawyer costs, defamation of character, and lost wages for time in court wouldnt have even cost you $50 from a decent lawyer if you explained your story.
But ya know its your driving record, your prerogative, and your choice. The only reason it peeves me is because its just another legal precedent set that makes the "old and innocent" feel like theyre entitled to take unjust action against the "young and reckless".
But I'll drop it now.
