View Full Version : Need help filing a complaint on another driver

So tonight i was coming home, doing 42 in a 45, and this guy in a Lexus IS250 passes me in a double solid line road with a hill. Well coming on the other side of that hill was on coming traffic. At the last second he pulls in front of me just, and I can't stress this enough, JUST missing a head on collision with the on coming traffic. I had to slam on my brakes just to let him i, otherwise he would of had the pit manuever put on him. He continued to drive well over 45, even when the road went down to 35. I caught up to him at the traffic light and asked him what the **** he was thinking. All he had to say to me was why don't I go **** my mother, and took off. His car had three other passengers in it. The only thing I got besides the Maroon colrd Lexus IS250 is part of his license plate which is CJD or CDJ and a New Jersy plate. He is also of hispanic or Italian race, judging by his accent he seemed to be italian or north jersian/new york.

Now my question is, can the police pursue finding this individual with only partial license plate, how do I file a complaint. I seriously want to let this guy have what he deserves in the court system.

please help me out here guys, I've had enough with people who not only drive irratically, but then thin they aren't in the wrong, and feel they don't need to apologize.

Contact local pd, they prob won't care but it should make you feel a little better.

file a police report with whatever town it happened in. hopefully he travels threw there frequently.

A ticket is basically a cop witnessing an act and filing a formal complaint. You witnessed an act and can file a complaint, its just that its your word against theirs if/when it goes to court.

i dont think it can work like that. they would need proof or wintness to the act.

Meh, just let it go. You did the right thing letting them in. If someone's determined to drive around you, the worst thing any one can do is speed up to not let them in.

This time tomorrow, you'll be over it and moved on with your life.

No point in me doing that. I knew that if I tried to stay with him I put not only myself, but others in danger, and that the light were heading to is a 5 way light and you sit there forever. The ****** part is the 35 zone has a school, and a community baseball field and jungle gym, and cops usually sit in that parkign lot catching people still doing 45....WTF!!

As far as pulling over, I shouldn't have to do anything for anybody behind me unless it's an emergency, and his pulling into the other lane wasen't exactly slow and smooth, it was more like he was taking me on the inside at Darlington pulling over into the lane. If he was in such a hurry, he should of left earlier, or taken RT.9. The only thing he did right was use his turn signal lol.

I'm still pissed, and I'm probably going to the station today to file.

I am terrible at that. As long as im doing at least the speed limit or higher, and someone goes to pass me. I gun it, idk y, its not smart. But i cannot help it lol. Its the ONE thing that gives me road rage, i shrug off when people cut me off, i dont think twice about idiot drivers, i make fun of them but thats it. The only thing that irks me is passing when im not going slow haha

I would have called 911 and reported it if it was that big a deal. I've done it before. Told them the make, model, some of the plate, and direction it was headed on a specific road.

WBT, I thought about that when I got home, that was my bad, I just felt at teh time instead of continuing on creating more tension on the situation (i.e. following him at his speeds, and/or possible accident like what happened to me last year) I felt i'd rather go to the station and file.

ok so....

you need a plate number, discription of car (to double check u have the correct plate number) and be able to ID the driver. you respond to PD HQ and sign a complaint, you must then go to court and back up your complaint.

as far as calling 911, its not techinicly a life or death emergency, so depending on the 911 operator it could be totaly disregarded, or what we do... get the general information and put out a general broadcast to all the police cars, but then again like someone mentioned, the police officer has to witness an infraction to be able to issue a summons

It will become a "He Said/ She Said" where you both have a different side to the story in court. He also has several witnesses in the car with him, and if they are his friends, they will back up a story that you are the POS and not him.
Waste of time to try to get him into court. Be thankful he didn't screw your car and let it go. Just my :2cents:

An officer does need to witness it, I work as a parking jockey for a police station and there's been plenty of near accidents, light taps of cars on pedestrians stuff like that and when an officer comes and hears the complaint from someone I've heard directly "If I didn't see it I can't ticket it"

The aggressive driving number is for you to call immediately after seeing an infraction. When you give the police the make/model and road you are on they will dispatch available units in the area to try and catch said vehicle in the act.

i think in a case like this its ok to call 911...if the driver was driving as crazy as the OP said thats putting someone elses life in danger..and who knows he could have been wasted and on the road, im not sure what would prompt somebody to drive like that other than being a total idiot. ive heard of much dumber 911 calls...lol

Can't do much here Jeff, sorry.

This can't be 100% true, otherwise there wouldn't be any tickets given at the scene of an accident unless it was witnessed by the responding officer.

If I remember correctly, my MIL was in an accident a few years ago, completely not her fault. However, the idiot that hit her went to the police station and said she was speeding. She was mailed a ticket. She was able to fight it in court (if I remember correctly the responding officer showed up to court with her and basically backed her up), but she still had to go.

you have the same luck as me, i am constantly having people pull out in front of me cutting me off or just acting like an a..! ive been rear ended 4 times hit in the side twice, some body cut in front of me while it was snowing then decided to turn into a wawa so i slid into them. but i do believe you can report them for aggressive driving, i may be wrong but i think its a law but you can call and report this.

I had a guy in an Audi A-4 swerving all over RT23 at about 4pm about 5 years ago. I called Wayne police and stayed with him. I crossed out of Wayne into Riverdale and finally Butler following him. The dispatcher actually transferred me to the towns I was following the guy in. They nailed him at the RT 23 Kiel Ave intersection. Very satisfying experience. If your hammred don't drive! Stupid S*** almost hit like 10 cars.

Being in law enforcement we get calls about other drivers alot and usually respond immediately call 911 report it as an iratics driver and give them the tags and direction of travel or follow them and give the police updates....

in a situation the OP described I would call 911. reason being the driver clearly is putting lives in danger carelessly which deserves an emergency response. I would assume #77 is people weaving in and out of traffic / tailgating etc.

Just to give you an update, I did go to the police station and two officers came out. One just wanted it over with and kept shooting me down, and tryign to walk away. The other one stood there, took his time, wrote everything I had to say, and assured me he would call me back wheither they catch him or not.

So I say boo to the one officer, and want to thank the other working on the case.

Without a license plate, probably nothing going to come of it. The cop that took time to listen to what you had to say probably enjoys doing his job and hopes to run into the J.O. at some point. 9-1-1 definitely appropriate if the driving is THAT bad. NEVER confront the driver. You never know which over-roided moron you're going to find yourself in a fight with...or which one will have a gun. Next time, either take a deep breath and move on with your life, or if it's serious enough and you feel the driver is a danger to others, call 9-1-1.

I would have let him pit himself on my fender. Someone did it to me a few years ago, same situation over a double yellow line. He wound up on someone's lawn with the suspension ripped off his car on the curb and a conviction on a 39:4-96 :mrgreen: My truck needed 10 minutes of polishing to get his paint off my chrome bumper.
