I don't even see the point of owning anything nice nowadays because people just mess it up. Driving home on Street Road Sunday night...in the left lane...an elderly guy who had no business having his license just flat out stops for no reason on a 45mph road...I slam on the brakes, almost come to a complete stop(still had room to stop) when a new Pathfinder towing a boat slams into me doing 50+mph....I give up....I really do. Didn't even make my first ****ing payment...1484 miles on her.
I don't think it's gonna be enough to total it and quite honestly I don't want the car back....the value is now completely destroyed and the car will never drive the same....so sad. :(
At least the old **** got a few tickets and may have to take his driver's test again...I hope he fails.

I'm still waiting on the estimate, I really really don't want the car back, it'll never be the same but the car stickered in the high high 40's...it's gonna take a lot to total it...hopefully they can look at the damage and deem it a constructive total loss.

I always fear the first door ding, this is a little more... ouch.
For some odd reason if it does get fixed and you can grab that damaged front bumper, Id like it. I have that prototype headlight from the '16 camaro(was listed on ebay before the car was revealed) and I'd like a front bumper to mount it to my garage wall with, kinda like the car broke though the wall, lol.

Sucks man. Going off of the pics, it looks very repairable. It also looks mostly cosmetic with minimal structure damage. If you take it to a good body shop, you shouldn't have a single issue with the car post repair. My buddy likes to pull cars into better than factory spec :lol: The biggest problem will be getting parts since it is brand new. Maybe they'll find a couple kinks in the roof or frame rails and it will total ;-)

SUCKS would be not enough for most of us:evil:. Hope no side effects on the health side. It would tough bullet to bite, but if it not totaled, trade it back in after repairs are made and see what the Dealer cost would be to replace it. You also now have a CARFAX stamp on the vehicles record that will follow it around and will hurt its resale value.

Terrible. Makes me not want to take my car out of the garage even more.
Maybe look into "Diminished Value" property loss. Sounds like it exists for this exact case, brand new car get significant damage, no way to return it to pre-accident value when factoring in accident history.

$19k in damages...still fixing it. It's actually not as bad as it looks, the parts are crazy expensive. I still don't want it back but the car stickered for almost $50K, it would take a lot to total it.
Yes, already lawyered up, going after lost wages, diminished value, I just lost at least 20% on the value now with a ****** CarFax. I'm still out of work, seem like it might be a pinched nerve in my back.
This is such a ****** situation. I hope the elderly **** has to retake his test and he fails miserably.

My sister recently crashed her SUV. The value was about $45k and the damages were estimated at $20-25k. Geico still totaled the car out as they figured the car could be auctioned in its current state for about the difference in value so it didn't make fiscal sense to repair it. I wonder why they didn't do the same for you since that car, with that motor, could still fetch a pretty penny at the auction.

Depends on the company. They all have different thresholds etc but the same motivation....

It's not even at 50% of ACV, it's not near the total loss threshold.
They're tearing down the front today but probably won't find much. I'm torn, I love this car, I can swap out the exhaust since the factory is $2400 so I can pocket some $$$ there, we're going after diminished value on the car so I can use that to pay some off or pay off other bills....but on the flip side the car very well may never be the same...and if they total it at least I wouldn't have a car payment for a while until I decided what to do.
I don't know...just super frustrating right now.

I'm going through my insurance(USAA) for the repairs, I'll let them go after the other insurance company for reimbursement, then my lawyer is going after his insurance company directly for lost wages(still out of work), medical bills that will exceed my policy limit, diminished value, loss of us, etc.

Hope this doesn't come across wrong but there's no way the pathfinder impacted you at 50+mph with a boat on the hitch. Its probably closer to half that, maybe a good bit less since it seems like it went over the top of your reinforcement bar in the rear and didn't do as much damage as I would expect/have seen. But I guess since you hit into the old guy some energy had to accelerate you again. I wonder, did the pathfinder end up jack-knifed? I tow mva's etc and spend too much time in a body shop so this **** interests me :lol:
Your pinched nerve/numbness is no joke though and I feel bad for you there. Hope that is just temporary and heals quickly. Did your air bags deploy?

He said he was doing 45-50mph. There a bunch of damage on the floor that can't be seen in the pics, he hit me good...maybe not 50 but definitely not 25mph.
He didn't jackknife to my knowledge, he ended up stopping what I would guess is a few hundred feet up the road. Air bags did not pop.

A ton of suspension damage, damage got into the cradle. The parts prices killed it, out of that $33k 20k was parts...crazy.

This actually makes the gears in my head start spinning. Like you said, the resale value on that car has just dropped tremendously... I'm not saying you are the type of person to do this but would it be possible to sue somebody for the depreciation of it?
Sure, his insurance will fix it but it's not worth what it previously was.

i know the feeling. My WS6 has been hit twice in the last 3 years, once parked and the other on RT 45 in jersey when some guy in a mini van blew a red light and took the nose of the car right off. Been debating on selling it myself.
Hope you have a speedy and easy recovery, but a rear end accident at that speed is brutal on your back; i can attest to it.

MRI should have just said "you're screwed" on it. A few ruptured discs, a herniated disc and a fractured one(but not letting any of the fluid out) which is causing major compression on a few nerve roots. Lost my new job over this too. All I know is that this better break the limited tort threshold so my lawyer can lawyer the hell out of everyone else involved. Needless to say I won't be in the car game for quite a while, hell unless I can get disability I maybe not even have a home in a few months....but this is life and you just gotta roll with the punches.
Did I mention I hate elderly people that can't drive?
