hate to tell you this but almost the very same thing happened to my son in his camaro last year. he lost the case and had to pay damages and got wreckless driving on hjs record

If I understand this right, she is claiming that something he drove carelessly and that resulted (even if tangentially) in her injuries, and he left.

Requesting discovery from the court will only provide you with any real evidence that is planned on being entered in to prove the plaintiff's case. At this point, I doubt it is anything besides the police report at this time.

OP- How did you find out about the suit and in what court are you being sued in? Also, if you were served with a summons and complaint, you need to answer in the complaint and you only have a limited amount of time to do that. Be sure to post up here before you answer.

I would get a lawyer and have the lawyer contact her explaining how you plan on not only defending yourself but also counter-suing for court fees, legal expenses, and wages lost during time in court.

I bet she'll **** her pants and drop it. In this day and age when the old (sorry to anyone not "young" but its true) try to take advantage of the young the only way to win is to prove your no dumbass and you can defend yourself and spin the whole thing around when the ball is in your court.

this. yeah I wouldnt try to go for gobs of money, just expenses to cover, she may realize it may cost her twice as much if she loses and may drop it, I certainly would if I was in the position, but then again Im not a douchy sue happy person, nor I hope I never have to......except for my current customer who wont pay for an engine I just rebuilt.

Lol that doesnt make you sue happy bro it just makes you a person that uses the legal system for what it was actually intended for...

As for the topic. See I would say go try to explain to her how ridiculous the whole thing is and that you completely plan on defending yourself and counter suing just to see if you can nip the thing in the bud but I think thats bad legal advise.

Btw perhaps you should go speak with the officer who filed the report and issued you the tickets? See what he has to say. I would put on the good memory hat and remember everything he says. If he even hints at the fact that its ridiculous or that he only filed the report because she insisted its just more **** to fling in court.

did i miss the part where the OP was getting sued? anyone can walk into a police dept with a license plate number and issue a civilian complaint, and it seems this lady has charged u with carless and leaving the scene

Yeah your absolutely right. And no it doesnt say anywhere hes being sued so I guess the term "counter sue" is incorrect in what we were saying.

I got ****ed like that in high school. Someone decided to file a complaint for reckless driving for doing a burnout. Little did I know that it wasnt actually issued by the cop that gave it to me in school. Wish I had known that cause I would have pled not guilty instead of having it reduced.

I bet if you go and plead not guilty she wont even be there to protest.
