Got pulled over
 
Ok so i got pulled over on 295 in Florence. The state trooper said i was speeding(he wasn't using his radar or pacing) and i was passing on the right. He ended up giving me a careless driving ticket which i know is 2 points. I have been to court before and i think i have used my 3 talks to the prosecutor to downgrade the charges. What should i do now? Should i just take the 2 points or should i try and downgrade it again?

i think what the officer observed him doing was going around a car in the right lane....and passing a car that was in the left lane on the right hand side, which would constitute weaving and warrant a careless driving ticket.



just the fact that your passing two people simultaneously on the right then the left and back again is enough to deem speeding.

You can always try to go to court and try to get it reduced, but if you have done so several times in the past few years, chances are they won't be too lenient.

just a heads up, was told a while back by a cousin' of mine's fiancee. (she works for a police dpt.) does something that has to do with the computers & processing
anyway, if you just pay the ticket and don't go to court. as long as you send a check in for the ticket paying over the amount (a dollar or 2) they are forced to generate a refund and supposedly if you don't cash the refund check,just throw it out. the proceessing can't be completed and no points will be assessed.

yeah, good luck with that. They'll just keep the $ after the refund expires. That or they'll just owe you that money for a long time. There's actually a website where you can look up if the state owes you money (for various reasons)

Get a lawyer and have it dropped to unsafe passing or something.

do you already have points on your license? if not id say talk to the prosecutor and eat the points if they dont let you talk down anything...

hiring a lawyer would get really expensive for just two points..

from what i read, he already used his 3 "free passes" to an unsafe driving.

just pay the 80 bucks and take the points. If you get it dropped down its unsafe operations and a 4xx something dollar ticket. those are really your only options unless you want to pay a lawyer

After my first ticket (reckless knocked down to careless) I figured I'd be better off just paying my tickets. I think the same goes for you

go to court, see if the prosecutor will please, if not pay up. not much more to lose in that scenario. there is no other magic plan to override your most recent youthful indiscretion. :)

I thought it was two free pass cards every 5 years.. ?

And I would just pay the man, and stop driving like an idiot. Not worth the court fees, ballooned ticket fee etc....

Yup, there it is. You used up your free passes so you are probably out of luck.

You are innocent untill proven guilty, so you can try to fight it that way, but really it will cost you a crap load of money, so no sense in doing that.
Your ticket is on careless driving, Id say take the 2 and be play it smart from here on out. Once a cop sees you with points, they will only add more. Invest in a radar detector, drive smart, dont swerve between cars, etc etc....

you can get 2 unsafe operation tickets within a 5 year period.

go to court and talk to the prosecutor. he/she may/may not plea bargain with you. pick the better resolution. derr

I got a Careless a year ago. Officer advised that I take it to court & plea it down to Unsafe.
My record was clean, though.
I did so and no points, just a $450 fine that I didn't mind paying at all.
My insurance is (thankfully) dirt cheap.
