Court question

I got a ticket...not going into the details but the cop let me off easy with a careless which is 2pts...anyways I want to go to court not to fight the ticket but to get the points removed. How would I do so? Do I have to plead not guilty? I would rather not because he gave me a huge break but o really don't want the points

NastyEllEssWon 05-16-2010 03:41 PM

id just pay up if he gave you a break...like a big break...cause trust me cops talk. he did you a solid, just pay up and settle your debt with uncle sam....next time the cop might not be so nice....especially if you got pulled over close to your home/in your town. theyll be watching

If you are planning on going to court trying to get a reduced ticket of 'unsafe driving' which has no points, be prepared to to pay a much higher fine. You would go, talk to the prosecutor and tell him you want to plead to 'unsafe' for no points.

If you don't have any points on your license currently, I might think about just paying it and taking the 2 points like Nasty said. This may be the cheaper method depending on how your insurance handles the 2 points you would accumulate.

Ya man just went through this last week :0 Show up to court about a half hour before your scheduled court time bring the ticket and your license and credit/debit card. When you sign in either say you would like to speak with the prosecutor or there will be an extra sign in sheet. They call you up, say you are admitting you were guilty looking to have the points reduced. If your driving record isn't all jacked up they usually say ok drop it to unsafe driving. Wait your turn for the judge, lawyers and what not go first he will say his little speech, then he will usually accept the plea bargain and you plead guilty and good to go.

My unsafe was $389 including the original fine, court costs and surcharge :( Better than insurance going /\

Just as an FYI, the vast majority of the time a cop gives you a break like that he'll indicate what you were actually doing in his ticket notes, so if you go to plead it down the prosecutor would be able to see that. Without knowing why you were actually pulled over, I can't say IMO whether you should try to fight it, but lets just say that if I were in your shoes and you should have been handed a ticket(s) for 5+ points, and you walked away with 2, you should prolly pay the small fine and leave well enough alone.

Oh and the cops don't know the outcome of any case unless you fight it and make him appear in court, if you reduce it you are admitting guilt, so you don't need to worry about them "coming after you later" in the end they make more $$$

lol i used to think like that. trust me, young kid, pewter ss, easily spottable car. trust me man, cops talk. honestly he got off lucky it sounds with a small 2 point ticket....even speeding tickets can be higher. You can only claim unsafe driving once every 2 or 3 years, for a maximum of 2-3 times in your LIFETIME.....you should save those ''free passes'' for a time when the cop isnt so forgiving.

B4C 05-16-2010 04:50 PM

I would have been in the negibrohood of 10 points...he did me a solid. Like I said I don't want to fight I know I was in the wrong and immediatly pulled over as soon as I saw him, i just want to pay off the points...can't you take a drivng course that dumps 2 points off ur record?

Every year with no additional points they remove 2 points from your license. If you don't have any points now, best bet is to just pay it. If you do have points and will be looking at surcharges if you take these, then you'll have to think a little more.

Pulling wheelies on the highway again with your beast?

tsk.

B4C 05-16-2010 05:50 PM

Well now that I think about it, would have been more than 10...he said since you have no points and you caught me in a good mood I'm gonna do you a favor...no, no weelies. Isn't there a defensive driving course you can take to get 2 points removed from ur lisc??

V 05-16-2010 05:54 PM

take the points, consider it a lesson learned, and motivation for no more points, for at least 3 years...

LTb1ow 05-16-2010 05:56 PM

My insurance did not go up when I got 5 and then knocked it down to 2 points... alas, I am out of get out of jail free cards for life though. :(

Call your insurance provider and ask open ended questions. They will find out you got the points whether you want to knock it down or not.

Slow-V6 05-16-2010 06:17 PM

When you go to court The judge then ask you how do you plead? If you plead not guilty then the Cop will tell the judge what you did and why he pulled you over. Then you will have a chance to make a statement to the judge and ask the officer any questions you want. They the judge will make the decision.

The way I got out of some points was to plead guilty and then askthe judge if I could say something. They usually let you speak and I basically would tell him that what I did was stupid and I know I was in the wrong. I normally dont drive like that or whatever and I have learned my lesson.

I always wore a suit or military uniform or nice pants and shirt. You dont want to look like you dont care up there in front of the judge and you dont want to laugh or smile either! Even if the judge cracks a joke. You just want to look upset with yourself and make him believe that you learned your lesson. Especially since you have no points and have been driving for 5 + years!

B4C 05-16-2010 06:36 PM

Again does anyone know if there is a driving course you can take to get 2 points removed from your lisc? I heard thee was one can someone confirm this?

B4C 05-16-2010 06:39 PM

Never mind there is I'll just do that to get rid of the points

JW 05-16-2010 10:27 PM

You can only take the defensive driving course every 5 years. Might not be worth doing it for only a 2 point ticket. If you have no more moving violations for a whole year you will lose those 2 points anyway.

But thats just my opinion... ugh I have been to defensive driving twice now.... its a long boring day.

You've posted up about it each time....it doesn't take a lot to remember it when it happens so frequently and posted in a public forum

Read your user title. You trying to defend him and say he's not a stalker is counter-productive.

NastyEllEssWon 05-17-2010 02:23 AM

well if you've had your license clean and clear for 5 years that would make you about 23...which doesnt really count when you say ''im sure you did dumb things when you were younger'' because im not much older than you

I knew that was coming but if he thinks about it, he hasn't exactly been secretive about this type of thing

Street Racing and just hitting it off from a red light isnt really the same thing. Some one can say they dont street race other cars but if they are first at a red light they might like to get on it a bit when the light turns green!

I romp on it every now and then just for the hell of it and if there were cops around they would pull me over and give me a reckless ticket which I have gotten. I also have raced cars from a stop light and I have also been pulled over doing this and have also gotten a reckless ticket!

If any of you say you have never gotten on your car then you are a lyer! When I test drove my car I beat the piss out of it just because I wanted to! Hell all the cars I have ever test drove I beat the piss out of. If there was a cop there then I would have gotten a ticket for reckless! Does that make me a street racer?
