Messed Up Situation
 
Sorry, I have to vent this out.

I purchased a pt4000 stall from a member on ls1tech with +12 feedback a week ago. I sent him a money order for $500, and he shipped it out quick and even sent me a tracking #.

I got the TC delivered by UPS and the input neck was smashed into an oval shape because the seller did a ****** job packaging it up (Pictures Below). Im not sure what he was thinking packing up a 30lb TC with a few peices of foam and a cost cutters bag.

So I contact the seller pretty pissed, but still respectful, and tell him what happened. I asked for a refund and told him that I would be shipping this back to him. (The shipper is responsible for claims, and they are the one to get compensation from UPS) I really doubted that UPS would award the money based on his ****** job at packaging.

This guy apologizes for the damage, and offers to pay for the damage, telling me to call Yank and get a quote. I talk to yank and they quote $300 to fix it. I tell the seller, then he completely stops answering my calls/texts/PMs for 4 days, which I sent every day. The cool thing about technology is that I can track his activity on LS1tech, and texts are confirmed received. I know he checked them but NO ANSWER.

I then open a claim at UPS to replace the part, claiming its new value of $845. UPS allows the receiver to open a claim, but the shipper gets the final compensation for damage.

Now 4 days since he stopped responding, I just got a text from the seller saying that UPS called him and they are going to cover it. Either he is bull****ting me, or I just made this snake a $445 profit for being a neglectful seller. Im still down the 500 with a broken converter to show for it.

Well hopefully the guy refunds you. I recently shipped a heater only box for a monte carlo out to New Mexico and it arrived broken. I'm doing whatever I can to get UPS to cover it even though the buyer is being really cool about it. If it were me I'd want a refund, and I already offered it to him but he wants to wait until UPS settles it.

If hes any kind of decent guy he will fix this situation for you

That is unfortunate. But hopefully you will get your money back from the seller.

And I agree that was a poor packing job.

I wouldnt be nearly as pissed if this guy actually worked with me to fix this. Basically Ive done everything from contacting yank to filing the ups claim. The real kicker is that UPS works with the shipper even though Ive done all the work and ended up with the damage and time loss. The seller wont respond to anything I send or call, basically hiding behind his inbox.

Im avoiding going public with this over on ls1tech because I feel like it would make it that much harder to see my money back from this guy

I think it is strange that he said UPS would cover it since they havent even inspected it yet, and I have it at my house (I setup for on site inspection). I checked the claims status and it says "Package Inspection Scheduled"

i agree with the two lasts posts... **** him man. Sorry you got burnt man. Its happened to me before and its not a good feeling. Hope it works out for you.

I used to do M.O.s & checks/cash for my online purchases, but never again. PayPal, while it does have it's moments, comes in handy at a time like this

Good luck, Kirk. Get in touch with UPS ASAP to let them know what's going on and what the seller has been saying. If you can, document your convos.

Same. As much as I think Paypal is a cash grab, this is why I like to use it.

I was on the selling end of something like this once. Original, complete console out of an LS-6 Chevelle. Not fun. UPS was a bitch to deal with.

At this point im regretting not using paypal. All conversation has been electronic...when he did respond. I think he's afraid to answer my daily phone calls.

Should I start a public thread on this or not on Ls1tech? Its pretty apparent that hes giving me the run around, but its still early since UPS hasnt inspected the damage yet.

I think worse case is that UPS doesnt award the damage cost and I have to hound this guy to take responsibility for the fix-it cost and wait another month to get the money, ship to yank, wait, and get it back.

Not sure what to do right now...

I would tell UPS exactly whats happening but possibly leave out the detail that it broke because of bad packing. Tell them it broke in transit and the seller is giving you the run around and you feel hes trying to dupe you for the insurance money and not refund what you payed.

That sounds like insurance fraud to me.

O and to add he will get the money. I had an item that apparently got stolen off the guys front porch when they left it at his house. I'm no thief so I sent him his money back and UPS refunded me. It took a month but its pretty much a classic Seinfeld scenario write off. Your refund isnt worth the hassle of fighting, harassment, and dealing with it so they just make it nice nice.

And I would say that someone handled that package quite rough to do that despite the bad packaging.

id request your 500 back from the seller. and keep the convertor. then fix it or whatever you wish.

in the end, he still made his 500 plus an extra 345... so he shouldnt care about wanting the part back.

then you can take 300 and have it fixed, of sell it damaged for 100 and buy a different one for say 600 then.

Just tell the seller, since hes getting the total new value refunded, you would like you 500 back to fix the part, claim its 300 repair plus like 75 shipping each way plus $50 for having it packed in a larger, stronger package... so itll cost you 500 to repair hence why you want the 500 back.
see what he says then. If UPS was really giving me back 845 as a seller, id have no problem giving the buyer back his original 500. the buyer would have just made me more money.

Well here is where Im at: The guy does not respond to any of the messages I send via PM, text, or phone calls. So I really have no idea what his intentions are for refunding me.

I emailed UPS notifying them that the shipper is not working with me on this. They responded basically saying that they are in contact with the shipper, and that I would be called later today to schedule a "damage inspection". I find this strange since the shipper sent me a text yesterday saying "UPS called and said they would cover it". Then did not respond to any of my questions about how it was going to be handled.

At this point, Ive already lost a lot of time and patience. I would take my 500 refund or the whatever the cost to fix it would be

I just talked to UPS and they are picking up the TC tomorrow, and said it should be inspected by next Tuesday at the latest. They then send it back to the original shipper and they cannot reveal any results of whether the damage is awarded to me as the receiver. The shipper gets whatever value to replace the part.

I told the UPS rep my situation with the shipper's lack of communication, and he said under contract the shipper gets notice and awarded value. I get nothing as the receiver and I would have to pursue the shipper for the refund.
