just like everyone else said a cop is a cop whether on duty or not. we have full powers 24/7. It depends on the department as to whether you are required to carry your gun, badge, and cuffs when your off duty. My department doesn't require it.
In that situation that officer has 30 days to file a summons against you. All he would do is take your info and have an officer from that town respond out and "co-sign" on the ticket. But if he never took your DL then he has no proof who was driving just that he saw the car by the license plate. Point being if you are around and somone identifies themselves as an officer and they show you their badge and id it's a good idea to comply, because there is a list of charges you can get hit with for not doing so.
And whoever brought up hitting an officer? Whether we are on duty or not after we identify ourselves, as little as pushing us can result in a 4th degree aggravated assault charge.
