You are correct, it is a violation of merchant contract, or something along those lines. However to get around that agreement, one must simply offer a discount for goods that one pays for in cash. So in reality they are saying that gas is 4.15 cents per gallon, but if you pay cash today we will sell it to you for 4.05. Simple and it works.
