What would he sue for? As of right now he's not injured and the car will be fixed...at best he'd sue for some diminished value on the vehicle since they'll probably hit him with some type of charge when he goes to turn it in.
Sorry about your luck...AGAIN. Hopefully this didn't mess with your surgery. I've never met you or anything but if I do I'm staying FAR FAR away from you if you go to a meet.  
Just wait and see how bad that estimate is going to be on the car...you're going to be surprised, especially if the wheel took any type of impact(couldn't tell from the pics). At least it's totally fixable.
I hope the pain doesn't get any worse and you make a speedy recovery.
