1. It's quite easy to scan the frequency band that GPS's use and individuals or companies interested in security would be able to detect it in a moment if it was "active"

2. You can't just slap a radio receiver or transmitter in any device if it is to be sold in the USA. That device must be registered with he FCC and public records are kept about every device model from cell phones to bluetooth dongles.

3. Even *if* there were gps's in most phones now a days, there are extremely strict and documented rules on how that can be used, generally, 911 calls exclusively.
