Lost title question

My buddy lives in Passaic and his neighbor has a '65 Mustang 289. It was her boyfriend's car and he went away on an extended iron vacation. She needs to get rid of the car and offered it to him. She dosen't have the title. Any way to get one without the owner?

I belive you need the current registration to get a copy of the title.

If the owner is still alive and there is no lien on it.. SOL. Only way is to put a lien on it and by the time you go through the system it will be a year or so.

Does she even have the right to sell it? I don't see that described here. Just the guy in the joint (I assume that what iron vacation means). You can't just sell someones stuff.

Thats what I got from the post. No way the title will transfer if the person is alive without them signing the title. Only other way is to put a lien on it for monies owed. (need to prove it and follow the steps to recoupe the money for the car)

That doesn't mean she can give it away/sell it. I think she'd have to report it abandoned and let the town tow it. That is why we have titles in the 1st place.

She has to have it ticketed and the police will tow and impound it, then the police will aution it off. That is the only way to get a hold of the car.

She cannot sell it without given Power of Attorney from the owner.

Can she get him to do a power of attorney on it?

If not let me know there is another way i know of, but it involves about $400 to get a title.. I almost had to do it for a 1990 mustang.

Could the woman say he owes for storage fees, since he just left it on her property? Depending on how long the car has been there, it could add up. Then a lien could be placed on it, and bought/titled by someone else.

it's funny, but you guys keep saying she can't sell it without his permission. that's crap. (ask me how i know?)

if she can secure a copy of the title, she most certainly can sell it by signing his name. since he won't be coming back, there is no repercussion to be aware of or expect, so she should just go ahead and sell it. of course, it would be so much easier if she had the paper copy of the title or if it was registered in her name or something, but that won't stop her selling it.

last i looked, speeding was illegal. your point?

like i said, if he ain't coming home, there are no reprisals. who's going to charge her with a crime? a criminal? how's he going to prove it? cops'll most likely laugh at him.

in my situation, i contacted a lawyer and was able to prove a crime had been comitted. he contacted the person in question and was told by her lawyer that she had sold the vehicle. he told me it would have well exceeded the cost of the vehicle to go beyond that point, but that criminal charges would've been pointless. understand, i was in a far better position legally than this guy is or ever will be.
