i hope you reconsider suing. getting hit from behind, all of the pain you have had to endure... it has a price tag attached to it, you know. you still have time (i think it's two years - check with an attorney) in which to file a claim. that way, in case some sneaky injury doesn't rear its ugly head for some time, you have recourse. i think you're in it enough to warrant a suit.

james you got to look at it this way, you cant be the nice guy cause your pain isnt that bad or genies either. if it was the other way around and you were in the kia hitting the benz you know for damn sure that your ass will be sued in a damn heartbeat and they wouldnt think twice about it. thats how this world is. at least do it to pay for the medical bills and your days off from work and other trips to the doctor that you may need to go to......

Benz's own.... My moms 2-door S500 got rear ended too.... the Ford Escort was a total. Our Benz got a fresh bumper. Benz's are like tanks.

im not saying sue for a Billion dollars, at least go get a free consultation with a lawyer, i spoke to larry and he said u can talk to his step dad cause he gives free consultations and he owes you a favor for getting him the discount on his moms benz.... just something to look into for ****s and giggles......

I honestly would sue. Martin, darknight7096, was working at circuit city and he was ordered to climb a shelf in the warehouse for a tv, he fell off the shelf and tore the back of his leg open. It required some 22 stitches and staples. Circuit City wouldn't even let him go to the hospital till he was finished filling out paperwork, as blood and goo was pouring outta the back of his leg. He wasn't gonna sue, wasn't gonna sue, then 2 months b4 the 2 year lawsuit deadline, he got pain back in his leg and then lost all feeling where he had the stitches and staples. Filed a lawsuit, and the lawyer for Circuit City said there was nothing wrong with him so he got $1,000. Goes to show, the pain might come back. Just something to think about!!

worker's compensation laws are a completely different animal. and, btw, if he settled for 1k, either he had a dufus for a lawyer or he got robbed. lost time at work alone is worth more than 1k. ask me how i know (i haven't worked since 2003, on social security which is a pittance, waiting for the case to settle - it's a subject that interests me so i studied it at length)...
personal injury, especially in an automobile, does not have the restrictions that worker's compensation does... basically, there is no limit, even though the insurance companies make you sign that higher tort threshold. even still, with two of them hurt and losing time at work, they will burn through that threshold very quickly.
i still say you should be considering a suit. at least go talk with a reputable lawyer (i do know of two, who are very good, but one works out of Princeton, and the other in Forked River, which is just north of Barnegat, so you might want to look in your area for one).

You can see the damage under the car which really absorbed the impact. The spare tire etc pushed up into the trunk.
