I understand if he didn't want to intervene to stop it at the time (but shouldn't have joined in), and definately should have notified his c/o immediately afterwards. Guess what, his cover is blown now.

I remember seeing that his department rules require him to report it immediately but do not intervene as that could blow his cover if he's on assignment.
