guys basically what happened is i got shafted i wasnt even at the scene when this happened. she is making the whole thing up... the **** fell down and got hurt somewhere and then got the idea a few days later to blame me so i would end up paying her medical bills but i plead guilty to deny her the ability to take me to civil

Well I'm glad for you that ya got the easy way out to not getting your ass sued.



As much as I hate to say it its young people (such as yourself) that settle for the plea bargains and enable the legal system (especially municipal) to walk all over us like we're "stupid kids".

If I was you I would have been contested all charges in court, then when she filed a civil I would have counter sued for defamation of character, lost wages, legal fees etc. I understand that not everyone wants to take the low road to be "right" in the end but **** is just out of control with what people get away with.

Heres the couple things I'd really like to know:

Was she even there in court?

Did she speak her side of the story or was it a total plea bargain with zero "trial"

Did the judge/prosecutor find the whole thing rediculous when you explained youself?

O and do you have it in writing that no further civil suit is to be filed?

Man that sucks. I can't see how she could prove that it was your car and not a cat that caused her to be pulled down. It isn't like they can cross examine the dog to find out why he was scared. Or her walking on a sidewalk at night and tripping over a crack and blamed it on someone else. All I’m saying is that I would have fought that one if it even made it to court.

Yea, I think I would of contested everythign and counter sued, in this day and age, judges are becoming more keen with stupid frivilous suits, and I'm sure that would of gotten thrown out of court. Did you use a public defender or an actual lawyer, cause I think he **** shafted you on that.

It's really not that bad of a deal in the end. I'd rather pay the state for a traffic violation than pay for her stupid medical bills. But it is a shame the police even took this seriously.

sometimes you gotta cut your losses and take one for the team. a traffic ticket and no chance of her suing you is way better than taking a chance in court and not only losing both charges, ending up in jail and having her sue you afterwards.

See, I probably wouldn't have.

A 2 pt careless ticket + insurance surcharges is probably still less than having to hire a lawyer in a civil suit for 4 hours, let alone an entire trial.

i agree too. i asked my mother whos a judge and she said something definately sounds out of place, especially since they can't prove that you were at the scene, hence no witnesses, you shouldn't have received anything and the case been dropped. theres no witnesses, no evidence that you caused her accident, the waiting period seems like she might've consulted with family member or friend that convinced her to try to get money, and it definately seems that someone shafted you because now you're going to have points, surcharges, and these things no one wants.

how did u find out that she fell a few days earlier anyway? i'd sue her and make her pay for the ticket. also, if you have a credible witness or evidence that she did fall earlier, you can get the police to arrest her for "filing a false police report" and so forth.

Are you a lawyer or did you stay at a Holiday Inn Express last night? Either way it's horrible advice, no offense.

His situation is done, he pleaded guilty after consulting a lawyer. For him to take any revenge(which he has no legal way to do so) is counter productive. What's done is done, he needs to just move on.
