busted

haha yeah i got pulled over for doing 61 in a 40 im a jackass.

oh well im just curious if anyone knows how much this ticket costs? he wrote it up as a 39:4-98 which is up to 14 mph over, so its a 2 point ticket but i dont know how much it costs. even though i was doing 14-29 over which is a 4 point ticket. and he set the court date for may 20th.....and ill be in Iraq haha, so im going to call the clerk tomorrow to see if i can get it changed.

so if he wrote it wrong (should be a 39:4-99) what does that mean? ive never been to court for a ticket and i have 0 points on my license, so any input would be appreciated.

39:4-98 is speeding, then they can check off the amount over the limit, just call up to find out the amount, but according to a tickt im looking at now it says on the back 10-14mph over is 95$, but its about 2 years old

oh thats not too bad. i have to call anyway about the court date.

but if he wrote it up as a 39:4-98, but wrote in the offense description "speeding 61 mph in a posted 40 mph zone" (which should be a 39:4-99) does that affect anything?

shouldnt set you back too much. if you do go to court im sure you could talk the prosecutor down.

did you tell the police officer that you were in the service?

yeah i told him i was going to be leaving for iraq may 18th. he told me to call the court clerk.

but again if he messed up on the ticket and wrote the wrong statute, does it get dropped, do they just charge me with the statute number, or the offense description? id rather have no points on my license and just pay the fine, but i know i did wrong and would just plead guilty.

All of that would be discussed at court. They can throw out the ticket for certain kinds of mistakes, but not everything.

Yea just show up, talk to the prosecuter if you have a clean record they'll throw the points out but the ticket will be more expensive.

called the clerk and my court date is now april 29th. can anyone give me a quick walk through of how this going to court thing works? i have never been and was hoping to keep it that way. what should i say to the prosecutor?

well you go to court, sign in, they call each person one by one to talk to the prosecutor(as long as you make your plea of not guilty before you go!) then you tell the prosecutor whatever you feel will help you (clean record, in the service, etc etc) and go from there...usually they will lower the offense.

ah ok. that helps a bit. i was just going to plead guilty but with his mistake maybe i can get the points dropped atleast. and maybe only pay like $100 instead of $200.

Even if you end up paying a few extra bucks, the points cost you more money in the long run. Just be honest with them and say you were int eh wrong, you accept that, and just let them know you would prefer to avoid the points so that you have a clean driving record when you get back from your deployment. 99 times out of 100 they are understanding and cool with it. Even if it costs you a few extra bucks now, it will save you a ton on your insurance when you get home.

dont say that you did it and all that..been through this too many times lol. Most of the prosecutors i've delt with didnt even take the time to hear what I had to say. Just be like look...I keep your freedom, hook a brotha up!

Or, lol, they will see your clean record and just give you a break and a decent fine, usually upwards of $200.

hes a DOD cop though, they deal with dumbass soldiers all day. did i mention this was near ft monmouth? i probably forgot but oh well. i could care less about paying, as long as its not like $1000. but i really dont want the points.

and how can i NOT admit that i did it? im an honest person but i wont **** myself over.

Last time I was in court judge told everyone that we have right to have 0 points twice in five years.

i think he was giving u a break if he cited u for only going up to 14 mph over the speed limit...thats what happened when i got pulled over....i was doing 105 in a 55 and he cited me as doing 90 in a 55 i wasnt gonna dispute it since it helped me out

i believe the statute number is all that the judge gets not the written comments. I doubt it will be thrown out because of what he did since the statute is lower then what u should have gotten and i wouldnt cause a big stink cuz then the judge might change it to the 4 point ticket.

i may just go in, plead not guilty, and hopefully like said above the prosecutor only gets the statute number and ill try to get 0 points instead of 2 for that particular statute and pay a little extra.
