Actually that's a good possibility. Hmmm....

and Big Al, our town doesn't need funds, we just live in an affluent suburban area where there is no crime. Only speeders and such so that's all the cops do.

39: 4-66 Emerging from alley, driveway or garage

a. The operator of a vehicle emerging from an alley, driveway, garage or private road or driveway, shall STOP the vehicle immediately prior to driving upon the sidewalk, and shall proceed to enter the sidewalk only after yielding the right of way to a pedestrian on the sidewalk, if the pedestrian is so close as to constitute an immediate hazard.

b. (Here's the kicker) In addition to any duty imposed under subsection a. of this section, the operator of a vehicle emerging from an alley, driveway, garage, or private road or driveway, SHALL STOP THE VEHICLE IMMEDIATELY PRIOR TO ENTERING OR CROSSING A HIGHWAY (All roads in NJ are called "Highways" by statute), AND SHALL PROCEED TO ENTER OR CROSS THE HIGHWAY only after yielding the right of way to the traffic on the highway, if the traffic is so close as to constitute an immediate hazard.

2 points. Talk to the prosecutor and try to get it downgraded to a no-points offense.

I've never had a ticket before and neither has she. How do you go about doing that? Tell her to wear a low cut shirt?

no, dress nice...when your sitting there the prosecutor will call her name and take her aside prior to the judge's hearing....they will usually offer a deal involving dropping the offence to something with no points ie. obstruction of traffic or unsafe operation....

be ready for the fine to be slightly higher but no points is what the goal of the night should be

Is she 17 also? Tell her to bring a parent and BOTH of them should speak to the prosecutor. The typical "downgrade" is Unsafe Operation of a Motor Vehicle (39: 4-97.1). No points, but it will cost a hair under $500 and usually has to be paid that night. Steep, but it beats paying $1000 over the next three years.

Yea I said I'll still pass it on.

79 t/a you seem to know quite a bit about this. Not sure if that's a good thing

And yea I plan to stop at the end of the driveway and spread the word. Since they didn't teach us that in driver's ed at my school.
