If he does not communicate with you in the coming week, file a small claims court. Might light a fire under his ass to just send you the money back, less of a hassle for him then to hire a lawyer, take time out of his day to go to court. If he decides to go to court with you well then whatever, btu best not to lay over and let him get away with it.

So he's got your $500 M.O., about to have the TC, and possibly the insurance money?

So, ideally, he'd get the broken TC back & the insurance money and send you a refund?--That's probably cheaper than shipping the TC back across country + dishing out the insurance check...

interesting.. i almost wouldnt let ups take the damaged item, and without shipping insurance stated on the original shipping invoice, max UPS will cover is $100. if he at least put $500, then they would cover that. but now i bet he didnt put anything, meaning 100 coverage.

Ive shipped a ton of things and bought stuff all using UPS and ive dealt with them several times. Anytime i ship anything, i declare the value as what i sold it for PLUS shipping costs, therefore if it does get damaged i can refund the entire amount the buyer paid and not be out of pocket on anything and in the end the buyer is happy. however good communication is the key and obviously thats not happening in this case. All said and done, take a lot of pictures and keep notes of who you speak to and when, and have the ups driver give you some type of paper of some kind, they should have some form saying they are picking it up i assume. worst case, he'll get his 500 bucks from UPS and stiff you, then youll need to persue it in greater depth. OR he may get the 500 from UPS and then feel comfortable giving you a refund once he has cash in had, because now he may be feeling he'll get ripped off.. its a tricky situation.



or... f the whole situation... dont give it to ups, say it was useable after all... and go pack it up again, poorly, have a friend mail it to another friend, and have them make their own claim for you lol. but thats just wrong.

lol, nice. but now if he refunds you like he says he will, all will be well, too bad u still need a TC. and even if he sends back the MO, which im sure he already cashed, with the receipt(part u tear off the MO and keep) im pretty sure you could get ur money back with his name still on it

I get shafted regardless of how this ends. He should send me an MO made out to me. I dont need any more of a hassle from this ordeal.

You have any evidence of him officially stating he promises to send you the money back? if so, its evidence against him to pay if he tries to shaft you.

I have a text message where he said he would pay for the damage, and hes now agreed to refunding me in two of the visitor messages in his profile. Saying and doing are completely different things though.

Update for those that care:

I got into contact with the UPS Account he used to ship the package (It was a pharmacy) and the owner agreed to hold the TC and awarded money until the shipper refunded me. He also informed me that the shipper only put $100 worth of insurance on it. (He's really going to be pissed when he figures that out)

I havent received a response from the seller for days, so I started a public thread on ls1tech: Messed Up Situation from 01wssick

I also posted everything in his visitor messages for him to find. Some other member brought up the public thread in 01wssick's for sale thread. I made a comment, and 01wssick snapped. Go to page 3.

Devil's advocate. How do you plan on forcing him to refund your money? Couldn't he just leave the TC at the pharmacy and never claim it? UPS would probably like that, too.

The next big step would be to open a small claims case. I really dont want to have to do that. The owner of the pharmacy realizes that since his account was used to ship it, he has some responsibility, and does not want to be caught in a legal crossfire. Holding the TC and UPS compensation until I get refunded is for both of our securities.

I was informed by the owner of the pharmacy that the shipper only put the default $100 insurance on it. So he is going to have to come up with another $400 out of his own pocket. I never intended to go after the guy like this, but I really have no sympathy for him. He screwed himself by not declaring the value and shipping it unsafely packed.

Im not sure how everything is going to pan out when the shipper realizes he has to pay for the damage.

****ed up situation man. That is one of the worst package jobs I have ever seen. It's stunning for any buyer who gets that kind of a poor shipment, with all of the positive feedback the seller has. Hope you get your money back.

Update:

Yesterday I received a text from 01wssick saying:

"Hey, Im sorry this is so ****ed up, I went to Webb's today and the guy that's handling it isnt in the rest of the day but he will be in tomorrow. So Im going in tomorrow to talk to him and confirm how much the claim is and etc. Then I'll get a money order out to you."

Today I got 2 emails from Mr. Webb (The acount holder used by 01wssick to ship the TC), saying:

2:30 pm

"I have not heard from Mr. [01wssick] today. UPS sent us a letter denying the insurance claim. They say the item was not packaged appropriately. I also received the item from UPS today. I will hold onto it until I hear that you have received a refund."

4:00 pm
"I met with Mr. [01wssick] a little while ago. He said he will ship a money order out to you today"

I sent 01wssick a text and got no response. I left a visitor message and got no response. UPS denied the claim due to "Insufficient packaging", meaning 01wssick is at fault for the damage. Im still waiting for a response, and more importantly, to be refunded.
