DWI: what do you do?

you get pulled over for a suspected DWI. the cop asks you to exit the vehicle for the roadside sobriety tests. what do you do?











i'll post up the correct response in a few days, based on a leading DWI lawyer's advice.

I'd say I can't exit the vehicle because my ass is asleep.... I didn't know an ass could fall asleep . (that's from a movie that everybody should see, very funny)
Personally I'd just get out and do the test seeing as I'm not drunk.

I'd jus get out and take it cuz not takint it can be just as damaginf to your license from what i understand.Plus when u sign for your license you sign an agrement saying u agree to take that when evr your asked to.

you can not refuse a field to participate in most states. i am pretty sure that jersey follows that standard.
i would hate to be in a position to have to supply an answer to an officer anyway.

don't confuse the field sobriety test with the breathalyzer. as for the bit about signing your license and you agree to take the test, that is also regarding the breathalyzer.

not bad, considering that most people are confused as hell what their rights are when they get pulled over. they think they have to do whatever the cop says to do, or there will be dire consequences. the deal is, the field sobriety tests are designed to make you fail. plain and simple. it's about the cop thinking you're drunk and making you prove it (against the 5th ammendment to the constitution). a lot of cops have the dashboard cameras hooked up these days, so not only are you proving to the cop that you're drunk, but you are proving it to whomever decides to watch it at a later date. the videotape might even get entered into evidence against you if you put on enough of a performce.

understand that refusing to participate does not guarantee that the cop will not arrest you becuase he's confused by your lack of desire to prove to him that you're drunk by failing his tests, but he's convinced that you are drunk... that's ok, though, as you have a much better chance taking the breathalyzer (at a later time, i might add) - which you have to insist on doing, otherwise this bit was for nothing. the only thing that removes alcohol from your body is time, so the longer it is from the time you had your last drink until the time you take the breathalyzer, the better.

among other sources, this is one that backs up my theory.

Well.... by now I know them all on first name basis.

I pull over.... usually before the cop catches up.
Roll window down
Shut car off
Throw keys on dash
Keep both hands on steering wheel.

woo i got it right...but here's my idea...

why not go through with the tests...i would guess that if you refuse to take em then you will more than likely end up at the police dept takin a breathalyzer...why not go through the tests and THEN go take the test as that will take up more time?

because the initial breathalyzer test may be higher than you want it to be.

also, most people who are even slightly tipsy do very poorly with the field sobriety tests.
