What else do you want? My soul?

As some of you may or may not know, but one of my other jobs is working for a small sports photographer as a part time assistant. It was working out pretty well making a few extra bucks on the occasional weekend every month or so on top of 2 other jobs & school.

Things haven’t been to great for the company in the past month and we haven’t been able to keep up with the work. Being the nice guy that I am I tried my absolute best to help out whenever I could. I didn’t pressure him for pay either this month since I knew he was struggling just to break even at events.

This past weekend I wasn’t able to work for him, but I still some how got suckered into working! It ruined a lot of things I had set aside for my family, my friends & school. I ended up working anyway and I was not happy.

Last week I was supposed to stop by and help him process a **** load of orders, but I had to call him and tell him I wasn’t going to be able to because of my other day jobs, family obligations & finals at school. Well the guy is pissed at me for not being able to work! I haven’t heard from him since the last time I called him Monday so I emailed him to check in and apologize for being so so busy and I also asked him about my paycheck. He responded to my email today with this:

“Yes, I have your check. I also would like to talk to you about the
status of your relationship with the company.”

What do I say to that? I do my absolute best to help this guy out but I have my own life to deal with too!

Tell him to pay you a doctors salary if he expects you to be "on call" 24/7 otherwise just pay you and you'll try to help out as much as you can, but working every weekend isn't going to be feasible.

You should probably remind him that you are a PART TIME assistant. That's not to say that you won't help out when you can (because it seems like that's what you are doing) but you have other obligations that are keeping you from being full time.

This is certainly a tough spot to be in, good luck with it.

I agree with pretty much everyone else, especially Bill's suggestion. You're working part time as an assistant for this guy and you're only getting paid for the hours YOU work.

while the situation sucks you don't want to burn bridges if this guy is in the field your interest in and knows a lot of people. The easiest way to screw up your career is to piss him off and have him say **** about you.

Just tell him you are sorry you couldn't work, but that you felt you were just part time and had made previous arrangements and that family and school at this point come first. If he can't understand that then just tell him your sorry that it's not going to work out it seems he needs a full time employee and you can't fit that in your schedule at this point in your life.

Use this as a learning experience when you are always saying yes and dropping everything there are some people who will take advantage of it, at least until your not there anymore.

Got these two things in my email tonight. Clearly he is trying to no have to pay me.

First of all I didn't break his GPS Unit. I did use it one night and the suction cup thing failed multiple times, only once did it actually hit the floor without me catching it but it continued to work for me the entire night until he used it. He has no proof I broke anything! And the whole head down thing on the table, I was resting my head saving myself from a massive headache after working for the past 12+ hours. I wasn't able to work for him in the past two weeks because I had multiple family engagements and school work to complete before I could commit to giving him any of my own personal time. The last part about the phone numbers from customers, I wasn't even the person taking customers he hired two other random people to help me I was processing orders the entire time. Its not my business, not my problem.

I didn't go and retrieve the check in person like I was going to because of this exact kind of BS. I know I would not have been able to keep my cool. He owes me a good $700+ dollars from the entire month of December.

I think I'm going to have to take legal action.

I think you might be thinking too deep into what appears to me as a simple matter. Its more than obvious that there is a dispute brewing between you and the company. From what you have told us, it sounds obvious that he is demanding too much for the part time position you held, and witholding compensation from you is a matter you have the right to take legal action in. However if that is the route you wish to take, know that he will use the same info you just posted as evidence against you and why you haven't been paid.

If you want advice, I say cut your losses, try to get him to pay you what he will, and then quit and move on. It sounds like you don't have time or extra money to jump into a legal dispute of which you may or may not end up on top of in the end.

I agree with call 911, if he owes you a couple hundred dollars, legal action isn't worth it, especially if the outcome isn't guaranteed. As call911 said, see what he's willing to pay you and maybe argue his story of the GPS. He doesn't have proof you broke it. Maybe just threaten legal action. Nothing can be proven, except that he owes you money that you earned.

Actually in the state of New jersey it is illegal for an employer to withhold your pay, deduct money from your pay check due to damaged or missing work tools, items ect,ect..
Unless they have your written consent..
That is why you have to fill out paperwork at a job to begin Medical benefits, 401K plans ect because they are required to have your written consent to with hold or deduct money from your paycheck..

And it is fully supported by the New Jersey department of Labor if you have a dispute they will file it for you for free and pursue it for you against the employer...
Plus you will be compensated with interest added on top of the money owed to you depending on how long they drag it out to pay you.
If I remember correctly I was given an additional 10% on top of the money that a past employer refused to pay me..

Even if you broke the guys GPS on purpose he legally can not deduct the money from your paycheck it is a civil matter..

yea that sounds like a good description steve. i guess it all depends on how the pay is and if its worth putting up with the BS just to gain some experience.
