you knew i'd be in here sooner or later. try this on for size:

(cliff's notes: if you don't have a medical condition requiring reduction of light, you cannot have window tint to the left and right of the driver or on the windshield.)

this first part talks about the seller of a motor vehicle equipped with tint telling the buyer what the statute is. otherwise, they can be fined by the state, as well as you getting a ticket for it.

An Act concerning motor vehicle window tinting and supplementing P.L.1960, c.39 (C.56:8-1 et seq.).

Be It Enacted by the Senate and General Assembly of the State of New Jersey:

C.56:8-117 Motor vehicle window tinting, informing customer of State restrictions; required. 1. It shall be an unlawful practice for a person engaged in the retail sale and installation of motor vehicle window tinting materials or film to:
a. Sell any such material or film without first notifying the purchaser that the application of these materials or film to the windshield or the front windows to the left and right of the driver of any motor vehicle registered in the State is a violation of State law and regulation. The notice required under this paragraph shall be given by the conspicuous posting of a sign at the point where the window tinting materials or film are offered for sale. The sign shall state substantially the following:
"NJ STATE LAW PROHIBITS ADD-ON TINTING ON WINDSHIELDS AND FRONT SIDE WINDOWS"
The notice required under this paragraph shall not apply to catalog sales of motor vehicle tinting materials or film where the purchase and payment are made by mail, telephone or other telecommunications or electronic method; or
b. Install or apply any such material or film on or to the windshield or the windows to the left and right of the driver of any motor vehicle registered in the State unless the purchaser exhibits a certificate or card, issued pursuant to P.L.1999, c.308 (C.39:3-75.1 et seq.), authorizing the installation or application of the material or film on or to the windshield or front windows to the left and right of the driver of that car for medical reasons involving ophthalmic or dermatologic photosensitivity.

C.56:8-118 Rules, regulations; public information program.
2. The Director of the Division of Consumer Affairs in the Department of Law and Public Safety shall:
a. Pursuant to the provisions of the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), promulgate rules and regulations to effectuate the purposes of this act; and
b. Develop and undertake a public information program to inform persons engaged in the retail sale and installation of motor vehicle window tinting materials and film and the general public of the provisions of this act.

3. This act shall take effect on the first day of the fourth month following enactment.

so, when we look up C.39:3-75.1, we get:

4B E I T E NACTED by the Senate and General Assembly of the State

71. Notwithstanding the provisions of any other law to the contrary,
8the owner or lessee of a motor vehicle that is driven by or is used to
9regularly transport a person who has a medical condition involving
10ophthalmic or dermatologic photosensitivity may apply to the director
11for permission to have the windshield and windows of that vehicle
12covered by or treated with a product or material that increases its light
13reflectance or reduces its light transmittance.
14The application shall be in a form and manner prescribed by the
15director and shall include, but not be limited to, a written certification
16by a certified ophthalmologist or a physician with a plenary license to
17practice medicine and surgery in this State or a bordering state that the
18person for whom the application is submitted has a medical condition
19involving ophthalmic or dermatologic photosensitivity. For the
20purposes of this act, medical conditions involving ophthalmic or
21dermatologic photosensitivity shall include:
22a. polymorphous light eruption;
23b. persistent light reactivity;
24c. actinic reticuloid;
25d. porphyrins;
26e. solar urticaria;
27f. lupus erythematosus; and
28g. such other photosensitive disorders or conditions as the director
29shall determine.

312. The director, pursuant to the "Administrative Procedure Act,"
32P.L.1968, c.410 (C.52:14B-1 et seq.), shall promulgate rules and
33regulations to effectuate the purposes of this act. The rules and
34regulations shall include, but shall not be limited to:
35a. Standards and specifications governing the types of materials
36and products that may be applied to a motor vehicle windshield and
37windows under this act. These standards and specifications shall
38include the color of the materials or products, the maximum allowable
39percentage of total light reflectance of the materials or products, the
40maximum allowable percentage of the light transmittance and
41ultraviolet transmittance of the materials or products, and such other

matters as the director shall deem appropriate and necessary. In
1establishing the standards and specifications, the director shall
2consider, to the greatest extent possible, the safety of law enforcement
3officers, who during the performance of their duties may find it
4necessary to inspect or otherwise observe the interior of a motor
5vehicle having a windshield and windows to which an approved
6material or product is applied.
7b. The issuance of a certificate or card to each approved applicant
8authorizing the approved covering or treatment. The certificate or
9card shall be valid for a period of not more than 48 months and shall
10be exhibited to any law enforcement officer, when so requested, and
11to a designated motor vehicle examiner whenever the motor vehicle is
12inspected.
13c. Standards and specifications governing the installation and
14application of approved materials and products, including the
15affixation of an appropriate label, in a manner and form prescribed by
16the director, on each windshield and window to which an approved
17material or product is applied. The label may identify the name and
18the location of the installer and the name of the manufacturer of the
19material or product applied.
20d. The registration of persons in the business of installing or
21applying approved materials and products, including the establishment
22of a fee to cover the costs of that registration.

243. a. A person who violates the provisions of subsection b. of
25section 2 of P.L. , c. (C. ) (now pending before the Legislature as
26this bill) shall be subject to a fine not exceeding $100; provided,
27however, if a person charged with such a violation can exhibit a
28certificate or card which was valid on the day he was charged to the
29judge of the municipal court before whom he is summoned to answer
30the charge, the judge may dismiss the charge. The judge, however,
31may impose court costs.
32b. A person who violates the provisions of the regulations adopted
33pursuant to subsection c. or d. of section 2 of P.L., c. (C. )
34(now pending before the Legislature as this bill) shall be subject to a
35fine not to exceed $1,000 for a first offense and not to exceed $5,000
36for a second or subsequent offense.

384. This act shall take effect on the first day of the13th month
39following enactment, except that section 2 shall take effect
40immediately.

44Permits application of certain tinting materials on motor vehicle
45windows and windshields for medical reasons.

so, the bottom line is that if you don't have a medical condition, certified by a doctor, of the skin or eyes where you need to have natural light reduced or you will suffer ill effects, then you cannot have tint on the front windows or on the windshield. cops will and do ticket you.

the first part basically says that the seller has to tell you about the law in NJ if the car is equipped with window tint. cops will and do ticket you.

bottom bottom line: no window tint or the cops will and do ticket you. no way out. no grandfather clause. period. end of story.

this is untrue. if the seller has the windows so tinted, they have to tell you what the statute says in NJ. it's ok in other states, because they don't forbid the windows being tinted, but in NJ they will ticket you whether it is "factory" installed or installed by your cousin willy.

if the law is currently enforceable, i will find it. i've got a nose for it.

and it's true that not all cops know all laws. some will write something but had meant to write something completely different. this is why we have our day in court.

i agree with u man...i got madd action in parking lots and on the road with my tints. i took them off and never got that action again..

all you people with front window tints enjoy that action..while it lasts..

we do inspections at my dealer and it says in the inspection booklet from the state that you are allowed to tint back window glass and rear windows if equipped with a 4 door vehicle, just 2 front windows and windshield are illegal to tint.

pretty sure that's what it is right there. windshield and front sides no tint. back okay. I mean it only makes sense just look at alll the minivans with tints. As long as you have both mirrors just as tru2chevy said. You will probably get pulled over, but you can fight it at court and win. there are plenty of vehicles on the road that dont have windows in the back at all. so why would they bother other people for tinting cars that do

I just want to throw one question out in the crowd. IF cops are so worried about someone having a gun on the other side of the window.................. Then why do 90% of cops when they see a car with tinted windows pull around like they are in some high speed pursuit with a drug dealer and armed robber to go after a car with tinted windows? I think it is a revenue thing IMO.

Tinted windows shouldn't be an issue. Any time I have gotten pulled over with tint(5%) my windows were down before the cop got out of his car. And if night time. Light was on.

With the except of the day in WashingtonTwp when my window motor was shot. And I only got the window down a 1/4 of an inch and had to yell out my window motors busted. LMAO.... Needless to say he practicaly almost had his gun out of the holster.
